 1-7                                   AN ACT
 1-8     relating to the Houston Downtown Management District.
 1-9           BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1-10           SECTION 1.  ENLARGEMENT OF BOUNDARIES.  (a)  The boundaries
1-11     of the Houston Downtown Management District created pursuant to
1-12     Subchapter A, Chapter 376, Local Government Code, are hereby
1-13     enlarged to include the territory contained in the following
1-14     described areas:
1-15           Annexation Area A - 378 acres, more or less, in the J. Austin
1-16     Survey, Abstract 1, the J. S. Holman Survey, Abstract 323, the O.
1-17     Smith Survey, Abstract 696, the S. Harris Survey, Abstract 327, S.
1-18     M. Williams Survey,  Abstract 87 and the J. Wells Survey, Abstract
1-19     832, Harris County, Texas, more particularly described as follows:
1-20     BEGINNING at a point along the Houston Downtown Management District
1-21     boundary at the intersection of the center line of the right-of-way
1-22     of Interstate Highway 45 with the center line of the right-of-way
1-23     of Franklin Avenue,
1-24           Thence in an easterly direction along the Houston Downtown
1-25     Management District boundary and the center line of the
1-26     right-of-way of Franklin Avenue to the intersection with a
1-27     southerly projection of the center line of the northbound ramp to
1-28     Interstate Highway 10, a continuation of Louisiana Street,
1-29           Thence in a northerly direction along the Houston Downtown
1-30     Management District boundary and the center line of the
1-31     right-of-way of the northbound ramp to Interstate Highway 10 and
1-32     the southerly projection thereof, to the intersection with the
1-33     center line of the Southern Pacific Rail Road's "Main Passenger
1-34     Line" right-of-way,
1-35           Thence in an easterly direction along the Houston Downtown
1-36     Management District boundary and the center line of the Southern
1-37     Pacific Rail Road's "Main Passenger Line" right-of-way to the
1-38     intersection with the center line of the right-of-way of North San
1-39     Jacinto Street,
1-40           Thence in a southerly direction along the Houston Downtown
1-41     Management District Boundary and the center line of the
1-42     right-of-way of North San Jacinto Street to the intersection with
1-43     the center line of the right-of-way of Commerce Avenue,
1-44           Thence in a southeasterly direction along the Houston
1-45     Downtown Management District boundary and the center line of the
1-46     right-of-way of Commerce Avenue to the center line of the
1-47     right-of-way of Austin Street,
1-48           Thence in a southwesterly direction along the Houston
1-49     Downtown Management District boundary and the center line of the
1-50     right-of-way of Austin Street to the intersection with the center
1-51     line of the right-of-way of Capitol Avenue,
1-52           Thence in a southeasterly direction along the Houston
1-53     Downtown Management District boundary and the center line of the
1-54     right-of-way of Capitol Avenue to the intersection with the center
1-55     line of the right-of-way of U.S. Highway 59,
1-56           Thence in a north and easterly direction with the center line
1-57     of the right-of-way of U.S. Highway 59 to the intersection with the
1-58     center line of the right-of-way of Interstate Highway 10,
1-59           Thence in a southwesterly direction with the center line of
1-60     the right-of-way of Interstate Highway 10 to the intersection with
1-61     the center line of the right-of-way of Interstate Highway 45,
1-62           Thence in a southerly direction with the center line of the
1-63     right-of-way of Interstate Highway 45 to The Point of Beginning,
1-64     containing 378 acres, more or less, including, without limitation,
 2-1     all air space above and all subsurface below said property.
 2-2           Annexation Area B - 95 acres, more or less, in the J. Austin
 2-3     Survey, Abstract 1, the J. S. Holman Survey, Abstract 323, the O.
 2-4     Smith Survey, Abstract 696, and the J. Wells Survey, Abstract 832,
 2-5     Harris County, Texas, more particularly described as follows:
 2-6           BEGINNING at a point along the southern boundary of the
 2-7     Houston Downtown Management District at the intersection of the
 2-8     center line of the right-of-way of U.S. Highway 59 with the center
 2-9     line of the right-of-way of Clay Avenue,
2-10           Thence in a northwesterly direction along the boundary of the
2-11     Houston Downtown Management District and the center line of the
2-12     right-of-way of Clay Avenue to the intersection with the center
2-13     line of the right-of-way of Caroline Street,
2-14           Thence in a southwesterly direction along the boundary of the
2-15     Houston Downtown Management District and the center line of the
2-16     right-of-way of Caroline Street to the intersection with the center
2-17     line of the right-of-way of Pierce Avenue,
2-18           Thence in a easterly direction with the center line of the
2-19     right-of-way of Pierce Avenue to the intersection with the center
2-20     line of the right-of-way of U.S. Highway 59,
2-21           Thence in a northeasterly direction with the center line of
2-22     the right-of-way of U.S. Highway 59 to The Point of Beginning,
2-23     containing 95 acres, more or less, including, without limitation,
2-24     all air space above and all subsurface below said property.
2-25           (b)  The boundaries of the Houston Downtown Management
2-26     District as enlarged by this Act shall include the territory
2-27     contained in the following described area:
2-28           1178 acres, more or less, in the J. Austin Survey, Abstract
2-29     1, the J. S.  Holman Survey, Abstract 323, the O. Smith Survey,
2-30     Abstract 696, the S. Harris Survey, Abstract 327, the S. M.
2-31     Williams Survey, Abstract 87 and the J. Wells Survey, Abstract 832,
2-32     Harris County, Texas, more particularly described as follows:
2-33           BEGINNING at the intersection of the center line of the
2-34     right-of-way of US Highway 59 with the center line of the
2-35     right-of-way of Capitol Avenue,
2-36           Thence in a southeasterly direction with the center line of
2-37     the right-of-way of Capitol Avenue to the intersection with the
2-38     center line of the right-of-way of Chartres Street,
2-39           Thence in a southwesterly direction with the center line of
2-40     the right-of-way of Chartres Street to the intersection with the
2-41     center line of the right-of-way of Clay Avenue,
2-42           Thence in a northwesterly direction with the center line of
2-43     the right-of-way of Clay Avenue to the intersection with the center
2-44     line of the right-of-way of US Highway 59,
2-45           Thence in a southwesterly direction with the center line of
2-46     the right-of-way of US Highway 59 to the intersection with the
2-47     center line of the right-of-way of Pierce Avenue,
2-48           Thence in a northwesterly direction with the center line of
2-49     the right-of-way of Pierce Avenue to the intersection with the
2-50     center line of the right-of-way of Bagby Street,
2-51           Thence in a northeasterly direction with the center line of
2-52     the right-of-way of Bagby Street to the intersection with a
2-53     southerly projection of the west line of the right-of-way of Heiner
2-54     Street,
2-55           Thence in a northerly direction with the west line of the
2-56     right-of-way of Heiner Street and southerly and northerly
2-57     projections thereof to the intersection with the center line of the
2-58     right-of-way of W. Dallas Street,
2-59           Thence in a westerly direction with the center line of the
2-60     right-of-way of W.  Dallas Street to the intersection with a
2-61     southerly projection of the west line of the right-of-way of Heiner
2-62     Street,
2-63           Thence in a northerly direction with the west line of the
2-64     right-of-way of Heiner Street and southerly and northerly
2-65     projections thereof to the intersection with the center line of the
2-66     right-of-way of Allen Parkway,
2-67           Thence in an easterly direction with the center line of the
2-68     right-of-way of Allen Parkway to the intersection with a southerly
2-69     projection of the center line of the right-of-way of Sabine Street,
 3-1           Thence in a northerly direction with a southerly projection
 3-2     of the center line of the right-of-way of Sabine Street and then
 3-3     with the center line of the right-of-way of Sabine Street to the
 3-4     intersection with the north right-of-way line of Memorial Drive,
 3-5           Thence in an easterly direction with the north right-of-way
 3-6     line of Memorial Drive to the intersection with the west
 3-7     right-of-way line of Interstate Highway 45,
 3-8           Thence in a northeasterly direction with the west
 3-9     right-of-way line of Interstate Highway 45 to the intersection with
3-10     the center line of the right-of-way of Franklin Avenue,
3-11           Thence in an easterly direction with the center line of the
3-12     right-of-way of Franklin Avenue to the intersection with the center
3-13     line of the right-of-way of Interstate Highway 45,
3-14           Thence in a northerly direction with the center line of the
3-15     right-of-way of the Interstate Highway 45 to the intersection with
3-16     the center line of the right-of-way of Interstate Highway 10,
3-17           Thence in an southeasterly direction with the center line of
3-18     Interstate Highway 10 to the intersection with the center line of
3-19     the right-of-way of US Highway 59,
3-20           Thence in a south and westerly direction with the center line
3-21     of the right-of-way of US Highway 59 to The Point of Beginning,
3-22     containing 1178 acres, more or less, including, without limitation,
3-23     all air space above and all subsurface below said property.
3-24           SECTION 2.  FINDINGS RELATED TO ENLARGED BOUNDARIES.  The
3-25     boundaries and field notes of the Houston Downtown Management
3-26     District as enlarged by this Act form a closure.  If a mistake is
3-27     made in the field notes or in copying the field notes in the
3-28     legislative process, the mistake does not in any way affect the:
3-29                 (1)  organization, existence, and validity of the
3-30     Houston Downtown Management District;
3-31                 (2)  right of the Houston Downtown Management District
3-32     to issue any type of bonds or refunding bonds for the purposes for
3-33     which the Houston Downtown Management District is created or pay
3-34     the principal of and interest on the bonds;
3-35                 (3)  right of the Houston Downtown Management District
3-36     to impose and collect assessments or taxes;
3-37                 (4)  validity of the enlargement of the Houston
3-38     Downtown Management District by this Act; or
3-39                 (5)  legality or operation of the Houston Downtown
3-40     Management District or its governing body.
3-41           SECTION 3.  VALIDATION.  The governmental acts and
3-42     proceedings of the Houston Downtown Management District and its
3-43     directors and officers occurring before the effective date of this
3-44     Act are validated as of the dates they occurred.
3-45           SECTION 4.  EMERGENCY.  The importance of this legislation
3-46     and the crowded condition of the calendars in both houses create an
3-47     emergency and an imperative public necessity that the
3-48     constitutional rule requiring bills to be read on three several
3-49     days in each house be suspended, and this rule is hereby suspended.
