                                A BILL TO BE ENTITLED
 1-1                                   AN ACT
 1-2     relating to the named insured on a workers' compensation policy
 1-3           BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
 1-4           SECTION 1.  Section 408.001, Labor Code is amended by adding
 1-5     the following:
 1-6           Sec. 408.001.  Exclusive Remedy; Exemplary Damages.  (a)
 1-7     Recovery of workers' compensation benefits is the exclusive remedy
 1-8     of an employee covered by workers' compensation insurance coverage
 1-9     or a legal beneficiary against the employer, or the parent
1-10     corporation, subsidiary corporation, or subsidiary of the parent
1-11     corporation of the employer, which are named insureds on the same
1-12     policy of workers' compensation insurance as the employer  or [an]
1-13     their agents or employees [of the employer] for the death of or a
1-14     work related injury sustained by the employee.
1-15           SECTION 2.  This act takes effect on September 1, 1999, and
1-16     applies to a compensable injury that occurs on or after that date.
1-17           SECTION 3.  The importance of this legislation and the
1-18     crowded condition of the calendars in both houses create an
1-19     emergency and an imperative public necessity that the
1-20     constitutional rule requiring bills to be read on three several
1-21     days in each house be suspended, and this rule is hereby suspended.
