1-1 AN ACT 1-2 relating to the reservation of riparian rights associated with land 1-3 sold by certain municipalities. 1-4 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: 1-5 SECTION 1. Section 272.001(h), Local Government Code, is 1-6 amended to read as follows: 1-7 (h) A municipality having a population of 250,000 or less 1-8 and owning land within 5,000 feet of where the shoreline of a lake 1-9 would be if the lake were filled to its storage capacity may, 1-10 without notice or the solicitation of bids, sell the land to the 1-11 person leasing the land for the fair market value of the land as 1-12 determined by a certified appraiser. While land described by this 1-13 subsection is under lease, the municipality owning the land may not 1-14 sell the land to any person other than the person leasing the land. 1-15 To protect the public health, safety, or welfare and to ensure an 1-16 adequate municipal water supply, property sold by the municipality 1-17 under this subsection is not eligible for and the owner is not 1-18 entitled to the exemption provided by Section 11.142(a), Water 1-19 Code. The instrument conveying property under this subsection must 1-20 include a provision stating that the exemption does not apply to 1-21 the conveyance. In this subsection, "lake" means an inland body of 1-22 standing water, including a reservoir formed by impounding the 1-23 water of a river or creek but not including an impoundment of salt 1-24 water or brackish water, that has a storage capacity of more than 2-1 10,000 acre-feet. 2-2 SECTION 2. The importance of this legislation and the 2-3 crowded condition of the calendars in both houses create an 2-4 emergency and an imperative public necessity that the 2-5 constitutional rule requiring bills to be read on three several 2-6 days in each house be suspended, and this rule is hereby suspended, 2-7 and that this Act take effect and be in force from and after its 2-8 passage, and it is so enacted. _______________________________ _______________________________ President of the Senate Speaker of the House I certify that H.B.
