A BILL TO BE ENTITLED
1-1 AN ACT
1-2 relating to credit in the Texas County and District Retirement
1-3 System for certain service as a peace officer.
1-4 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1-5 SECTION 1. Subchapter E, Chapter 843, Government Code, is
1-6 amended by adding Section 843.405 to read as follows:
1-7 Sec. 843.405. PREVIOUS PEACE OFFICER SERVICE. (a) A
1-8 contributing member may establish credit for current service in the
1-9 retirement system for service previously performed as a peace
1-10 officer:
1-11 (1) licensed by the Commission on Law Enforcement
1-12 Standards and Education; and
1-13 (2) commissioned by a state agency included in the
1-14 coverage of the Employees Retirement System of Texas.
1-15 (b) A member claiming credit under this section shall file a
1-16 detailed statement of the service with the retirement system and
1-17 deposit with the system the actuarial present value of the
1-18 additional standard service retirement benefits that would be
1-19 attributable to the credit based on rates and tables recommended by
1-20 the actuary and adopted by the board of trustees.
1-21 (c) After the retirement system verifies the service and
1-22 receives the deposit required by Subsection (b), the system shall
1-23 grant the current service credit.
1-24 (d) Credit may not be established under this section for
2-1 service while it is credited in the Employees Retirement System of
2-2 Texas.
2-3 SECTION 2. Section 845.306(a), Government Code, is amended
2-4 to read as follows:
2-5 (a) The retirement system shall deposit in a member's
2-6 individual account in the employees saving fund:
2-7 (1) the amount of contributions to the retirement
2-8 system deducted from the member's compensation;
2-9 (2) interest allowed on money in the account in
2-10 accordance with this subtitle;
2-11 (3) an amount deposited by a member in accordance with
2-12 Section 845.405 to establish credited service during a time of war;
2-13 (4) the portion of a deposit required by Section
2-14 843.003 or 843.404 to reinstate credited service previously
2-15 terminated that represents the amount withdrawn;
2-16 (5) the amount deposited in accordance with Section
2-17 843.301(b) or 843.402(b) to establish credit for prior or current
2-18 service for a person who became a member in accordance with
2-19 Subchapter C of Chapter 842;
2-20 (6) the amount deposited by a member in accordance
2-21 with Section 843.601(e) to establish current service credit for
2-22 military service;
2-23 (7) the amount deposited by a member in accordance
2-24 with Section 843.501 to establish credit for legislative service;
2-25 [and]
2-26 (8) the amount deposited by a person to become a
2-27 member in accordance with Section 842.103; and
3-1 (9) the amount deposited by a member in accordance
3-2 with Section 843.405(b).
3-3 SECTION 3. This Act takes effect September 1, 1999.
3-4 SECTION 4. The importance of this legislation and the
3-5 crowded condition of the calendars in both houses create an
3-6 emergency and an imperative public necessity that the
3-7 constitutional rule requiring bills to be read on three several
3-8 days in each house be suspended, and this rule is hereby suspended.
