                                A BILL TO BE ENTITLED
 1-1                                   AN ACT
 1-2     relating to regulation of quarries or pits in certain counties.
 1-3           BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
 1-4           SECTION 1.  Chapter 133, Natural Resources Code, is amended
 1-5     by adding section 133.091(b) to read as follows:
 1-6           Section 133.091.  COUNTY AUTHORITY TO REGULATE.  (a)  A
 1-7     county with a population of 2.4 million or more may adopt
 1-8     regulations requiring the placement of signs or barriers on
 1-9     aggregate quarries and pits.
1-10           (b)  A county with a population of 270,000 or more and is
1-11     adjacent to two or more counties with a population of one million
1-12     or more may adopt regulations for aggregate quarries or pits that
1-13     are not inconsistent with this Chapter and Section 133.093.
1-14           SECTION 2.  This Act takes effect September 1, 1999.
1-15           SECTION 3.  The importance of this legislation and the
1-16     crowded condition of the calendars in both houses create an
1-17     emergency and an imperative public necessity that the
1-18     constitutional rule requiring bills to be read on three several
1-19     days in each house be suspended, and this rule is hereby suspended.
