No. 2764 1-2 (In the Senate - Received from the House May 5, 1999; 1-3 May 6, 1999, read first time and referred to Committee on 1-4 Intergovernmental Relations; May 14, 1999, reported favorably by 1-5 the following vote: Yeas 4, Nays 0; May 14, 1999, sent to 1-6 printer.) 1-7 A BILL TO BE ENTITLED 1-8 AN ACT 1-9 relating to the authority of a county to regulate automotive 1-10 wrecking and salvage yards. 1-11 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: 1-12 SECTION 1. Section 238.001(1), Local Government Code, is 1-13 amended to read as follows: 1-14 (1) "Automotive wrecking and salvage yard" means a 1-15 business other than a business classified as a salvage pool 1-16 operator under Article 6687-1a, Revised Statutes, that stores three 1-17 or more wrecked vehicles outdoors for the purpose of: 1-18 (A) selling the vehicles whole; or 1-19 (B) dismantling or otherwise wrecking the 1-20 vehicles to remove parts for sale or for use in an automotive 1-21 repair or rebuilding business. 1-22 SECTION 2. This Act takes effect September 1, 1999. 1-23 SECTION 3. The importance of this legislation and the 1-24 crowded condition of the calendars in both houses create an 1-25 emergency and an imperative public necessity that the 1-26 constitutional rule requiring bills to be read on three several 1-27 days in each house be suspended, and this rule is hereby suspended. 1-28 * * * * *
