1-12           Between "agency" and "that" (HOUSE ENGROSSMENT, page 1, line
1-13     22) insert ", other than an institution of higher education,"
1-14                            A BILL TO BE ENTITLED
1-15                                   AN ACT
1-16     relating to information that certain state agencies must post on
1-17     the Internet.
1-18           BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1-19           SECTION 1.  Subchapter F, Chapter 2054, Government Code, is
1-20     amended by adding Section 2054.121 to read as follows:
1-21           Sec. 2054.121.  REQUIRED POSTING OF INFORMATION ON INTERNET.
1-22     Each state agency that receives an aggregate amount of
1-23     appropriations in the  General Appropriations Act for a state
1-24     fiscal biennium that exceeds $175 million shall post the following
1-25     information during the biennium on a generally accessible Internet
1-26     site maintained by or for the agency:
1-27                 (1)  an analysis of all agency expenditures during the
1-28     two preceding state fiscal years that lists each county in the
1-29     state and states for each county the amount of agency expenditures
1-30     made in or for the benefit of the county;
1-31                 (2)  if the information required to substantially
1-32     comply with Subdivision (1) is not available, an analysis that
1-33     approximates compliance with Subdivision (1) to the greatest
1-34     possible extent by listing agency expenditures according to
1-35     geographic regions of the state, to the extent possible, and by
1-36     each field office of the agency;
1-37                 (3)  a profile of the governing officer or of each
1-38     member of the governing body of the agency that includes, among
1-39     other information, the office address of the officer or member;
1-40                 (4)  a listing and description of all contracts with
1-41     vendors that have a value exceeding $15,000 that the agency has
1-42     entered into and that are currently being performed or for which
1-43     performance has not yet begun;
1-44                 (5)  a brief description of the agency's duties; and
1-45                 (6)  an electronic link to the agency's rules as
1-46     published in the electronic version of the Texas Administrative
1-47     Code and an electronic link to any written procedure of the agency
1-48     relating to agency hearings that is not contained in the electronic
1-49     version of the Texas Administrative Code.
1-50           SECTION 2.  This Act takes effect October 1, 1999.
1-51           SECTION 3.  The importance of this legislation and the
1-52     crowded condition of the calendars in both houses create an
1-53     emergency and an imperative public necessity that the
1-54     constitutional rule requiring bills to be read on three several
1-55     days in each house be suspended, and this rule is hereby suspended.
