No. 2863 76R9160 T A BILL TO BE ENTITLED 1-1 AN ACT 1-2 relating to the salary of a retired judge or justice assigned to a 1-3 district court. 1-4 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: 1-5 SECTION 1. Subsections (h) and (i), Section 74.061, 1-6 Government Code, are repealed. 1-7 SECTION 2. This Act takes effect September 1, 1999. 1-8 SECTION 3. The importance of this legislation and the 1-9 crowded condition of the calendars in both houses create an 1-10 emergency and an imperative public necessity that the 1-11 constitutional rule requiring bills to be read on three several 1-12 days in each house be suspended, and this rule is hereby suspended. 1-13 COMMITTEE AMENDMENT NO. 1 1-14 Amend HB 2863, page 1, line 6, by striking "repealed" and 1-15 substituting "amended to read as follows": 1-16 (h) Notwithstanding Subsection (c), the salary from the 1-17 state of a retired judge or justice assigned to a district court is 1-18 determined pro rata on the sum of the regular judge's salary from 1-19 the county plus the greater of: 1-20 (1) the regular judge's salary from the state on 1-21 August 31, 1997; or 1-22 (2) 85 percent or a greater percentage not to exceed 1-23 100% of the regular judge's salary from the state as established by 1-24 the General Appropriations Act for any fiscal year. 2-1 (i) Notwithstanding Subsection (d), the salary from the 2-2 state of a former judge or justice assigned to a district court is 2-3 determined pro rata on the greater of: 2-4 (1) the regular judge's salary from the state on 2-5 August 31, 1997; or 2-6 (2) 85 percent or a greater percentage not to exceed 2-7 100% of the regular judge's salary from the state as established by 2-8 the General Appropriations Act for any fiscal year. 2-9 Thompson
