                                A BILL TO BE ENTITLED
 1-1                                   AN ACT
 1-2     relating to the compensation of part-time and temporary full-time
 1-3     faculty members at public institutions of higher education.
 1-4           BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
 1-5           SECTION 1.  Subchapter Z, Chapter 51, Education Code, is
 1-6     amended by adding Section 51.9085 to read as follows:
 1-7           Sec. 51.9085.  MINIMUM SALARIES FOR TEMPORARY AND PART-TIME
 1-8     FACULTY.  (a)  In this section:
 1-9                 (1)  "Academic year" means the fall semester and the
1-10     following spring semester.
1-11                 (2)  "Institution of higher education" has the meaning
1-12     assigned by Section 61.003.
1-13                 (3)  "Part-time faculty member" means a person who is
1-14     employed by an institution of higher education as a faculty member
1-15     and who is paid for each course the person teaches.
1-16                 (4)  "Temporary full-time faculty member" means a
1-17     faculty member employed by an institution of higher education for
1-18     one academic semester at a time.
1-19           (b)  The minimum salary for a part-time faculty member is:
1-20                 (1)  for the 1999-2000 academic year, $900 per semester
1-21     credit hour of instruction; and
1-22                 (2)  for the 2000-2001 academic year, $1,100 per
1-23     semester credit hour of instruction.
1-24           (c)  The minimum salary for a temporary full-time faculty
 2-1     member is:
 2-2                 (1)  for the 1999-2000 academic year, $1,100 per
 2-3     semester credit hour of instruction; and
 2-4                 (2)  for the 2000-2001 academic year, $1,300 per
 2-5     semester credit hour of instruction.
 2-6           (d)  An institution may not pay a faculty member covered by
 2-7     this section a salary or wages in an amount less than the
 2-8     applicable minimum salary provided by this section.
 2-9           (e)  If an institution pays a faculty member covered by this
2-10     section less than the minimum salary required by this section, the
2-11     comptroller shall reduce the amount of the next transfer or
2-12     transfers of money appropriated to the institution that may be used
2-13     for instruction by an amount equal to the amount of formula funding
2-14     attributable to the semester credit hours taught by the faculty
2-15     member when the faculty member was paid less than the required
2-16     minimum salary.  For purposes of this subsection, the amount of
2-17     formula funding is determined according to the formulas developed
2-18     for the applicable academic year by the Texas Higher Education
2-19     Coordinating Board under Section 61.059 and the institution's
2-20     appropriation request prepared using those formulas.
2-21           (f)  This section expires January 1, 2002.
2-22           SECTION 2.  The importance of this legislation and the
2-23     crowded condition of the calendars in both houses create an
2-24     emergency and an imperative public necessity that the
2-25     constitutional rule requiring bills to be read on three several
2-26     days in each house be suspended, and this rule is hereby suspended,
2-27     and that this Act take effect and be in force from and after its
 3-1     passage, and it is so enacted.
