No. 2914 76R9429 CMR-D A BILL TO BE ENTITLED 1-1 AN ACT 1-2 relating to notice of the drug testing policy followed by a 1-3 convalescent or nursing home or a home and community support 1-4 services agency. 1-5 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: 1-6 SECTION 1. Subchapter A, Chapter 142, Health and Safety 1-7 Code, is amended by adding Section 142.007 to read as follows: 1-8 Sec. 142.007. NOTICE OF DRUG TESTING POLICY. An agency 1-9 licensed under this chapter shall provide to the following persons 1-10 a written statement describing the agency's policy for the drug 1-11 testing of employees who have direct contact with clients: 1-12 (1) each person applying for services from the agency; 1-13 and 1-14 (2) any person requesting the information. 1-15 SECTION 2. Subchapter B, Chapter 242, Health and Safety 1-16 Code, is amended by adding Section 242.0371 to read as follows: 1-17 Sec. 242.0371. NOTICE OF DRUG TESTING POLICY. An 1-18 institution licensed under this chapter shall provide to the 1-19 following persons a written statement describing the institution's 1-20 policy for the drug testing of employees who have direct contact 1-21 with residents: 1-22 (1) each person applying for services from the 1-23 institution; and 1-24 (2) any person requesting the information. 2-1 SECTION 3. This Act takes effect September 1, 1999. 2-2 SECTION 4. The importance of this legislation and the 2-3 crowded condition of the calendars in both houses create an 2-4 emergency and an imperative public necessity that the 2-5 constitutional rule requiring bills to be read on three several 2-6 days in each house be suspended, and this rule is hereby suspended.
