A BILL TO BE ENTITLED 1-1 AN ACT 1-2 relating to notifying consumers of a nursing home's or a home and 1-3 community support services agency's policy regarding drug testing 1-4 of employees. 1-5 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: 1-6 SECTION 1. Subchapter A, Chapter 142, Health and Safety 1-7 Code, is amended by adding an appropriately numbered section to 1-8 read as follows: 1-9 Sec. ____. If a consumer requests information about an 1-10 agency licensed under this chapter or applies for services from an 1-11 agency licensed under this chapter, the information provided by the 1-12 agency shall include a statement briefly describing the agency's 1-13 policy regarding drug testing of employees who have direct contact 1-14 with clients. 1-15 SECTION 2. Subchapter B, Chapter 242, Health and Safety 1-16 Code, is amended by adding an appropriately numbered section to 1-17 read as follows: 1-18 Sec. ____. If a consumer requests information about an 1-19 institution licensed under this chapter or applies for services 1-20 from an institution licensed under this chapter, the information 1-21 provided by the institution shall include a statement briefly 2-1 describing the institution's policy regarding drug testing of 2-2 employees who have direct contact with clients. 2-3 SECTION 3. This Act takes effect September 1, 1999. 2-4 SECTION 4. The importance of this legislation and the 2-5 crowded condition of the calendars in both houses create an 2-6 emergency and an imperative public necessity that the 2-7 constitutional rule requiring bills to be read on three several 2-8 days in each house be suspended, and this rule is hereby suspended.
