                                A BILL TO BE ENTITLED
 1-1                                   AN ACT
 1-2     relating to the verification of the social security number and
 1-3     lawful presence in the United States of a driver's license holder
 1-4     or applicant.
 1-5           BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
 1-6           SECTION 1.  Section 521.044(a), Transportation Code, is
 1-7     amended to read as follows:
 1-8           (a)  Information provided on a driver's license application
 1-9     that relates to the applicant's social security number and any
1-10     information that may verify an applicant's social security number
1-11     may be used only by the department or disclosed only to:
1-12                 (1)  the child support enforcement division of the
1-13     attorney general's office; or
1-14                 (2)  another state entity responsible for enforcing the
1-15     payment of child support.
1-16           SECTION 2.  Section 521.101(d), Transportation Code, is
1-17     amended to read as follows:
1-18           (d)  The department may require each applicant for an
1-19     original, renewal, or duplicate personal identification certificate
1-20     to furnish to the department the information required by Sections
1-21     [Section] 521.142 and 521.147.
1-22           SECTION 3.  Section 521.142, Transportation Code, is amended
1-23     by amending Subsection (a) and adding Subsection (g) to read as
1-24     follows:
 2-1           (a)  An application for an original license must state the
 2-2     applicant's full name, [and] place and date of birth, and social
 2-3     security number.  This information must be verified by presentation
 2-4     of proof [of identity] satisfactory to the department.
 2-5           (g)  The department may require an applicant to produce any
 2-6     documents it determines to be necessary to verify information on an
 2-7     application.
 2-8           SECTION 4.  Subchapter G, Chapter 521, Transportation Code,
 2-9     is amended by adding Sections 521.147 and 521.148 to read as
2-10     follows:
2-11           Sec. 521.147.  LEGAL RESIDENCE REQUIREMENT.  (a)  The
2-12     department may deny or cancel any original, renewal, or duplicate
2-13     driver's license or personal identification certificate if an
2-14     applicant does not submit satisfactory proof that an applicant's
2-15     presence in the United States is authorized under federal law.
2-16           (b)  The department shall cancel a driver's license or
2-17     personal identification certificate for a person after receiving
2-18     notice from the United States Immigration and Naturalization
2-19     Service that the person is unlawfully in the United States.
2-20           (c)  An applicant who submits for the purposes of this
2-21     section a birth certificate or other documentation issued outside
2-22     the United States must offer proof of being legally in the United
2-23     States.
2-24           Sec. 521.148.  SOCIAL SECURITY VERIFICATION.  (a)  The
2-25     department may verify through the Social Security Administration:
2-26                 (1)  a social security number provided by an applicant
2-27     for an original, renewal, or duplicate driver's license or personal
 3-1     identification certificate; and
 3-2                 (2)  any social security number on file with the
 3-3     department.
 3-4           (b)  The department may deny or cancel any original, renewal,
 3-5     or duplicate driver's license or personal identification
 3-6     certificate if the social security number provided by the applicant
 3-7     does not correspond with the information obtained by the department
 3-8     through the verification process with the Social Security
 3-9     Administration.
3-10           SECTION 5.  This Act takes effect September 1, 2000.
3-11           SECTION 6.  The importance of this legislation and the
3-12     crowded condition of the calendars in both houses create an
3-13     emergency and an imperative public necessity that the
3-14     constitutional rule requiring bills to be read on three several
3-15     days in each house be suspended, and this rule is hereby suspended.
