No. 2944 76R5236 PAM-F A BILL TO BE ENTITLED 1-1 AN ACT 1-2 relating to the transfer of certain state property from the Texas 1-3 Department of Criminal Justice to the Board of Regents of the Texas 1-4 State University System. 1-5 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: 1-6 SECTION 1. (a) Not later than January 31, 2000, the Texas 1-7 Department of Criminal Justice shall transfer to the Board of 1-8 Regents of the Texas State University System for use by Sam Houston 1-9 State University the real property described by Subsection (e) of 1-10 this section. 1-11 (b) The Texas Department of Criminal Justice shall transfer 1-12 the property by an appropriate instrument of transfer. 1-13 (c) The instrument of transfer must include a provision 1-14 that: 1-15 (1) requires Sam Houston State University to use the 1-16 property only for a governmental purpose; and 1-17 (2) indicates that ownership of the property will 1-18 automatically revert to the Texas Department of Criminal Justice if 1-19 Sam Houston State University uses the property for any purpose 1-20 other than a governmental purpose. 1-21 (d) The Texas Department of Criminal Justice shall retain 1-22 custody of the instrument of transfer after the instrument of 1-23 transfer is filed in the real property records of Walker County. 1-24 (e) The real property referred to in this section is 2-1 described as follows: 2-2 Being an 345.58 acre tract of land located in the John Porter 2-3 Survey, Abstract 38, Walker County, Texas, and being a portion of a 2-4 residue of 1664.85 acres of land conveyed in deed from Albert E. 2-5 Cunningham and wife, Julia S. Cunningham to the State of Texas for 2-6 the Texas Department of Corrections, dated November 10, 1959, and 2-7 recorded in the Deed Records of Walker County in Volume 165, Page 2-8 138; said 345.58 acre tract being more particularly described by 2-9 metes and bounds as follows: 2-10 BEGINNING at a concrete TxDOT monument found for the most westerly 2-11 cutback corner of the intersection of the northeasterly right of 2-12 way line of FM (Farm to Market) 980, based on a width of 80.00 2-13 feet, recorded in Volume 129, Page 236, of the Deed Records of 2-14 Walker County, and the northwesterly right of way line of SH (State 2-15 Highway) 19, based on a width of 230.00 feet, and having grid 2-16 coordinates of X= 3842823.28, Y= 10308432.06; all bearings and 2-17 coordinates are based on the Texas State Plane Coordinate System, 2-18 Central Zone, NAD 83, Adj. 1993. The importance of this legislation and the 8-10 crowded condition of the calendars in both houses create an 8-11 emergency and an imperative public necessity that the 8-12 constitutional rule requiring bills to be read on three several 8-13 days in each house be suspended, and this rule is hereby suspended, 8-14 and that this Act take effect and be in force from and after its 8-15 passage, and it is so enacted.
