                                A BILL TO BE ENTITLED
 1-1                                   AN ACT
 1-2     relating to the transfer of certain state property from the Texas
 1-3     Department of Criminal Justice to the Board of Regents of the Texas
 1-4     State University System.
 1-5           BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
 1-6           SECTION 1.  (a)  Not later than January 31, 2000, the Texas
 1-7     Department of Criminal Justice shall transfer to the Board of
 1-8     Regents of the Texas State University System for use by Sam Houston
 1-9     State University the real property described by Subsection (e) of
1-10     this section.
1-11           (b)  The Texas Department of Criminal Justice shall transfer
1-12     the property by an appropriate instrument of transfer.
1-13           (c)  The instrument of transfer must include a provision
1-14     that:
1-15                 (1)  requires Sam Houston State University to use the
1-16     property only for a governmental purpose; and
1-17                 (2)  indicates that ownership of the property will
1-18     automatically revert to the Texas Department of Criminal Justice if
1-19     Sam Houston State University uses the property for any purpose
1-20     other than a governmental purpose.
1-21           (d)  The Texas Department of Criminal Justice shall retain
1-22     custody of the instrument of transfer after the instrument of
1-23     transfer is filed in the real property records of Walker County.
1-24           (e)  The real property referred to in this section is
 2-1     described as follows:
 2-2     Being an 345.58 acre tract of land located in the John Porter
 2-3     Survey, Abstract 38, Walker County, Texas, and being a portion of a
 2-4     residue of 1664.85 acres of land conveyed in deed from Albert E.
 2-5     Cunningham and wife, Julia S. Cunningham to the State of Texas for
 2-6     the Texas Department of Corrections, dated November 10, 1959, and
 2-7     recorded in the Deed Records of Walker County in Volume 165, Page
 2-8     138; said 345.58 acre tract being more particularly described by
 2-9     metes and bounds as follows:
2-10     BEGINNING at a concrete TxDOT monument found for the most westerly
2-11     cutback corner of the intersection of the northeasterly right of
2-12     way line of FM (Farm to Market) 980, based on a width of 80.00
2-13     feet, recorded in Volume 129, Page 236, of the Deed Records of
2-14     Walker County, and the northwesterly right of way line of SH (State
2-15     Highway) 19, based on a width of 230.00 feet, and having grid
2-16     coordinates of X= 3842823.28, Y= 10308432.06; all bearings and
2-17     coordinates are based on the Texas State Plane Coordinate System,
2-18     Central Zone, NAD 83, Adj. 1993.  To convert to surface
2-19     coordinates, divide by a combined scale factor of 0.99988; NGS
2-20     Station BL 2006 bears South 3417'48" East, a grid distance of
2-21     5280.90 feet.
2-22     THENCE, North 4815'45" West, along the northeasterly right of way
2-23     line of FM 980, a distance of 1086.25 feet to a 5/8-inch iron rod
2-24     set for an angle point;
2-25     THENCE, North 4954'44" West, continuing along the northeasterly
2-26     right of way line of FM 980, a distance of 1312.47 feet to a
2-27     5/8-inch iron rod set for a point of curvature;
 3-1     THENCE, in a northwesterly direction, continuing along the
 3-2     northeasterly right of way line of FM 980, with a curve to the
 3-3     left, having a central angle of 0255'23", a radius of 5769.58 feet,
 3-4     an arc length of 294.34 feet, and a chord bearing of North 5122'25"
 3-5     West, a distance of 294.31 feet to a 5/8-inch iron rod set for the
 3-6     point of tangency;
 3-7     THENCE, North 5250'07" West, continuing along the northeasterly
 3-8     right of way line of FM 980, a distance of 630.14 feet to a
 3-9     5/8-inch iron rod set for a point of curvature;
3-10     THENCE, in a northwesterly direction, continuing along the
3-11     northeasterly right of way line of FM 980, with a curve to the
3-12     left, having a central angle of 0637'26", a radius of 994.93 feet,
3-13     an arc length of 115.02 feet, and a chord bearing of North 5608'50"
3-14     West, a distance of 114.96 feet to a 5/8-inch iron rod set in the
3-15     southeast line of that certain tract of land as conveyed in deed to
3-16     Horace M. Reeves and Mary Frances Reeves, dated December 16, 1993,
3-17     and recorded in Volume 211, Page 629 of the Official Public Records
3-18     of Walker County;
3-19     THENCE, North 1438'33" West, along the easterly line of said Reeves
3-20     tract, a distance of 186.96 feet to a fence corner for the
3-21     northeast corner of said Reeves tract;
3-22     THENCE, North 6458'09" West, along the northerly line of said
3-23     Reeves tract and a fence line, a distance of 236.19 feet to a
3-24     3-inch iron pipe found in the southerly line of a residue of 100
3-25     acres of land conveyed in deed to Sam W. Robbins, dated August 30,
3-26     1947, and recorded in Volume 120, Page 310, of the Deed Records of
3-27     Walker County;
 4-1     THENCE, North 42 10'24" East, along the southerly line of said
 4-2     Robbins tract and a fence line, a distance of 2439.03 feet to a
 4-3     2-inch iron pipe found for the southeast corner of a residue of 100
 4-4     acres of land conveyed in deed to Phillip M. Campbell, et al, dated
 4-5     May 9, 1985, and recorded in Volume 445, Page 408 of the Official
 4-6     Public Records of Walker County;
 4-7     THENCE, North 47 35'56" West, along the easterly line of said
 4-8     Phillip M. Campbell, et al tract and a fence line, a distance of
 4-9     3064.51 feet the Livingston Reservoir Pool Line, as described in
4-10     deed to the Trinity River Authority, dated August 26, 1969, and
4-11     recorded in Volume 223, Page 758 of the Deed Records of Walker

 8-3     line of SH 19, a distance of 575.88 feet to a 5/8-inch iron rod set
 8-4     for the most easterly cutback corner of the intersection with FM
 8-5     980;
 8-6     THENCE, South 6826'42" West, along said cutback corner, a distance
 8-7     of 162.00 feet to the POINT OF BEGINNING and containing 345.58
 8-8     acres of land.
 8-9           SECTION 2.  The importance of this legislation and the
8-10     crowded condition of the calendars in both houses create an
8-11     emergency and an imperative public necessity that the
8-12     constitutional rule requiring bills to be read on three several
8-13     days in each house be suspended, and this rule is hereby suspended,
8-14     and that this Act take effect and be in force from and after its
8-15     passage, and it is so enacted.
