No. 2995 A BILL TO BE ENTITLED 1-1 AN ACT 1-2 relating to crossing an intersection in a vehicle. 1-3 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: 1-4 SECTION 1. Subchapter G, Chapter 545, Transportation Code, 1-5 is amended by adding Section 545.3021 to read as follows: 1-6 Sec. 545.3021. ENTERING INTERSECTION. An operator may not 1-7 enter an intersection unless the operator can expect to exit the 1-8 intersection without halting and impeding cross traffic. 1-9 SECTION 2. Sections 545.151(b), (d), and (e), Transportation 1-10 Code, are amended to read as follows: 1-11 (b) An operator on a single-lane or two-lane street or 1-12 roadway who approaches an intersection that is not controlled by an 1-13 official traffic-control device, or that is controlled by a 1-14 traffic-control signal that is not operating, and that is located 1-15 on a divided highway or on a street or roadway divided into three 1-16 or more marked traffic lanes: 1-17 (1) shall stop, yield, and grant immediate use of the 1-18 intersection to a vehicle on the other street or roadway that is 1-19 within the intersection or approaching the intersection in such 1-20 proximity as to be a hazard; and 1-21 (2) after stopping, may proceed when the intersection 1-22 can be safely entered without interference or collision with 1-23 traffic using a different street or roadway. 1-24 (d) Except as provided in Subsection (e), an operator 2-1 approaching an intersection of a street or roadway that is not 2-2 controlled by an official traffic-control device, or that is 2-3 controlled by a traffic-control signal that is not operating: 2-4 (1) shall stop, yield, and grant immediate use of the 2-5 intersection to a vehicle that has entered the intersection from 2-6 the operator's right or is approaching the intersection from the 2-7 operator's right in a proximity that is a hazard; and 2-8 (2) after stopping, may proceed when the intersection 2-9 can be safely entered without interference or collision with 2-10 traffic using a different street or roadway. 2-11 (e) An operator approaching an intersection of a street or 2-12 roadway from a street or roadway that terminates at the 2-13 intersection and that is not controlled by an official 2-14 traffic-control device or controlled as provided by Subsection (b) 2-15 or (c), or that is controlled by a traffic-control signal that is 2-16 not operating: 2-17 (1) shall stop, yield, and grant immediate use of the 2-18 intersection to another vehicle that has entered the intersection 2-19 from the other street or roadway or is approaching the intersection 2-20 on the other street or roadway in a proximity that is a hazard; and 2-21 (2) after stopping, may proceed when the intersection 2-22 can be safely entered without interference or collision with the 2-23 traffic using the other street or roadway. 2-24 SECTION 3. This Act takes effect September 1, 1999. 2-25 SECTION 4. The importance of this legislation and the 2-26 crowded condition of the calendars in both houses create an 2-27 emergency and an imperative public necessity that the 3-1 constitutional rule requiring bills to be read on three several 3-2 days in each house be suspended, and this rule is hereby suspended.
