                                A BILL TO BE ENTITLED
 1-1                                   AN ACT
 1-2     relating to Texas State Cemetery Annex.
 1-3           BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
 1-4           SECTION 1.  Section 2165.256, Government Code is amended by
 1-5     amending Subsection (b), (1), (2), (3) and (4) to read as follows:
 1-6           Sec. 2165.256.  STATE CEMETERY AND OTHER BURIAL GROUNDS.
 1-7           (b)  In addition to the property described as Lot No. 5,
 1-8     Division B, City of Austin, Travis County, Texas, the following
 1-9     property is dedicated for cemetery purposes as part of the State
1-10     Cemetery:  [BEING APPROXIMATELY 50.00 ACRES OF LAND OUT OF AND A
1-11     PORTION OF THE FOLLOWING DESCRIBED TRACT OF LAND.  75.688 RECORD
1-12     ACRES OF LAND OUT OF THE GEORGE W. SPEAR SURVEY IN THE CITY OF
1-13     AUSTIN, TRAVIS COUNTY, TEXAS, DESCRIBED BY DEED TO THE STATE OF
1-14     TEXAS AS RECORDED IN VOLUME 76, PAGE 225, OF THE DEED RECORDS OF
1-15     TRAVIS COUNTY, TEXAS, SAID 75.688 ACRE TRACT OF LAND BEING MORE
1-16     PARTICULARLY DESCRIBED AS FOLLOWS:]
1-17                 (1)  BEING 44.07 ACRES OF LAND OUT OF THE GEORGE W.
1-18     SPEAR LEAGUE IN THE CITY OF AUSTIN, TRAVIS COUNTY, TEXAS, AND BEING
1-19     OUT OF AND A PORTION OF THAT CERTAIN TRACT OF LAND DESCRIBED BY
1-20     DEED TO THE STATE OF TEXAS AS RECORDED IN VOLUME 776, PAGE 225, OF
1-21     THE DEED RECORDS OF TRAVIS COUNTY, TEXAS.  SAID 44.07 ACRES OF LAND
 2-1     BEING MORE PARTICULARLY DESCRIBED AS FOLLOWS:
 2-2                       (A)  BEGINNING at a set brass cap in concrete for
 2-3     the northwest corner of said State of Texas tract, same being the
 2-4     west corner of Lot 34 of Shoal Village, Section Two, a subdivision
 2-5     in the City of Austin, Texas, as recorded in Book 5, page 150, of
 2-6     the Plat Records of Travis County, Texas, and being on the east
 2-7     right-of-way line of Bull Creek Road (an existing 60' R/W) and
 2-8     being the northwest corner of this tract;
 2-9                             (i)  THENCE S 62 05'02" E, along the north
2-10     line of said State of Texas tract of land, same being the south
2-11     line of said subdivision, a distance of 919.08 feet to a set brass
2-12     cap in concrete for an angle point in the north line of said State
2-13     of Texas, tract of land same being an angle point in the south line
2-14     of Lot 45 of Shoal Village, Section Three, a subdivision of record
2-15     in the City of Austin, Texas, as recorded in Book 6, Page 71, of
2-16     the Plat Records of Travis County, Texas;
2-17                             (ii)  THENCE along the north line of said
2-18     State of Texas, tract of land, same being the south line of the
2-19     following subdivisions in the City of Austin, Texas, said Shoal
2-20     Village, Section Three, Shoal Village, Sec. 5, as recorded in Plat
2-21     Book 6, Page 72, of the Plat Records of Travis County, Texas, Shoal
2-22     Village, Sec. 6, as recorded in Plat Book 7, Page 7, of the Plat
2-23     Records of Travis County, Texas, Shoal Village, Section Seven, as
2-24     recorded in Plat Book 14, Page 80, of the Plat Records of Travis
2-25     County, Texas, Oak Haven, Section Three, as recorded in Book 11,
 3-1     Page 40, of the Plat Records of Travis County, Texas, the following
 3-2     two (2) courses and distances:
 3-3                                            (I)  S 63 02'45" E, a
 3-4     distance of 306.61 feet, a 1/2 "iron rod found, and
 3-5                                            (II)  S 63 11'57" E, a
 3-6     distance of 327.57 feet to the point of intersection with the
 3-7     centerline of Shoal Creek for the northeast corner of this tract;
 3-8                             (iii)  THENCE along the centerline of Shoal
 3-9     Creek with its meanders, same being the east line of this tract,
3-10     the following seven (7) courses and distances:
3-11                                            (I)  S 03 49'32" E, a
3-12     distance of 146.37 feet, a 1/2" I.R. set;
3-13                                            (II)  S 11 51'40" W, a
3-14     distance of 68.56 feet, a 1/2" I.R. set;
3-15                                            (III)  S 17 44'58" E, a
3-16     distance of 255.55 feet, a 1/2" I.R.  set;
3-17                                            (IV)  S. 11 22'50" W, a
3-18     distance of 433.59 feet, a 1/2" I.R.  set;
3-19                                            (V)  S 01 30'40" E, a
3-20     distance of 208.10 feet, a 1/2" I.R. set;
3-21                                            (VI)  S 03 34'39" E, a
3-22     distance of 163.82 feet, a 1/2" I.R. set; and
3-23                                            (VII)  S 12 53'44" E, a
3-24     distance of 44.69 feet, to a P. K. nail set in concrete for the
3-25     southeast corner of this tract;
 4-1                             (iv)  THENCE N 62 12'25" W, departing from
 4-2     said Shoal Creek, passing the northeast corner of Lot 24 of
 4-3     Ridgelea, a subdivision in the City of Austin, Texas, as recorded
 4-4     in Book 4, page 258, of the Plat Records of Travis County, Texas,
 4-5     at 59.90 feet, a total distance of 414.19 feet to a found 1/2" iron
 4-6     rod under concrete for the most northerly corner of Lot 21 of said
 4-7     Ridgelea subdivision, said point also being a re-entrant corner of
 4-8     this tract;
 4-9                             (v)  THENCE S 31 29'35" W, along the most
4-10     southerly east line of said State of Texas tract of land, same
4-11     being the west line of said Ridgelea subdivision, a distance of
4-12     715.50 feet to a 1/2" iron rod set for a southwest corner of this
4-13     tract, from this point the northwest corner of Lot 11, same being
4-14     the southwest corner of Lot 12, of said Ridgelea subdivision bears
4-15     N 31 29'35" E, a distance of 10.64 feet;
4-16                             (vi)  THENCE through said State of Texas
4-17     tract of land the following four (4) courses and distances:
4-18                                            (I)  N 23 52'33" W, passing
4-19     a brass cap in concrete set at 5.00 feet, a total distance of
4-20     654.65 feet to a brass cap in concrete set for a corner,
4-21                                            (II)  N 06 26'42" E, a
4-22     distance of 308.11 feet, a brass cap in concrete set for a corner,
4-23                                            (III)  N 14 01'31" W, a
4-24     distance of 894.05 feet, a brass cap in concrete set for a corner,
4-25     and
 5-1                                            (IV)  N 63 17'00" W, a
 5-2     distance of 478.50 feet to a brass cap set in concrete at the point
 5-3     of intersection with the east right-of-way line of Bull Creek Road,
 5-4     same being the west line of said State of Texas tract of land, and
 5-5     being the most northerly southwest corner of this tract;
 5-6                             (vii)  THENCE N 26 43'00" E, along said
 5-7     right-of-way line, a distance of 496.30 feet to the Point of
 5-8     Beginning, and containing 44.07 acres of land, more or less.

5-17     Texas;]

5-20     Texas;]

 6-8     subdivision of record in the City of Austin, Texas, as recorded in
 6-9     plat Book 4, Page 258, of the Plat Records of Travis County,
6-10     Texas.]
6-11           SECTION 2.  This Act takes effect September 1, 1999.
6-12           SECTION 3.  The importance of this legislation and the
6-13     crowded condition of the calendars in both houses create an
6-14     emergency and an imperative public necessity that the
6-15     constitutional rule requiring bills to be read on three several
6-16     days in each house be suspended, and this rule is hereby suspended.
