A BILL TO BE ENTITLED
1-1 AN ACT
1-2 relating to Texas State Cemetery Annex.
1-3 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1-4 SECTION 1. Section 2165.256, Government Code is amended by
1-5 amending Subsection (b), (2) to read as follows:
1-6 Sec. 2165.256. STATE CEMETERY AND OTHER BURIAL GROUNDS.
1-7 (b) In addition to the property described as Lot No. 5,
1-8 Division B, City of Austin, Travis County, Texas, the following
1-9 property is dedicated for cemetery purposes as part of the State
1-10 Cemetery: [BEING APPROXIMATELY 50.00 ACRES OF LAND OUT OF AND A
1-11 PORTION OF THE FOLLOWING DESCRIBED TRACT OF LAND. 75.688 RECORD
1-12 ACRES OF LAND OUT OF THE GEORGE W. SPEAR SURVEY IN THE CITY OF
1-13 AUSTIN, TRAVIS COUNTY, TEXAS, DESCRIBED BY DEED TO THE STATE OF
1-14 TEXAS AS RECORDED IN VOLUME 76, PAGE 225, OF THE DEED RECORDS OF
1-15 TRAVIS COUNTY, TEXAS, SAID 75.688 ACRE TRACT OF LAND BEING MORE
1-16 PARTICULARLY DESCRIBED AS FOLLOWS:]
1-17 (2) BEING A 2.120 ACRE (92.350 SQUARE FEET) TRACT OF
1-18 LAND OUT OF THE GEORGE W. SPEAR LEAGUE IN TRAVIS COUNTY, TEXAS.
1-19 SAID 2.120 ACRE TRACT OF LAND ALSO BEING OUT OF A 31.12 ACRE TRACT
1-20 HAVING BEEN CONVEYED TO THE STATE OF TEXAS BY INSTRUMENT OF RECORD
1-21 IN VOLUME 776, PAGE 225, DEED RECORDS OF TRAVIS COUNTY, TEXAS.
2-1 SAID 2.120 ACRE TRACT BEING MORE PARTICULARLY DESCRIBED BY METES
2-2 AND BOUNDS AS FOLLOWS:
2-3 (A) BEGINNING, at a brass disk in concrete found
2-4 on the southeasterly right of way line of Bull Creek Road. Said
2-5 disk also being at the northernmost corner of said 31.12 acre tract
2-6 and the westernmost corner of a 44.07 acre tract also out of the
2-7 tract described in volume 776, page 225 for the northernmost corner
2-8 of the herein described tract,
2-9 (B) THENCE, S63 17'00" E, 350.00 feet with the
2-10 northeasterly line of said 31.12 acre tract and a southwesterly
2-11 line of said 44.07 acre tract to a 1/2" iron rod set for the
2-12 easternmost corner of the herein described tract;
2-13 (C) THENCE, S26 42' 58" W, 205.49 feet with the
2-14 southeast line of this 2.120 acre tract to a 1/2" iron rod set for
2-15 the herein described tract, nearby a concrete driveway;
2-16 (D) THENCE, W82 57' 38" W, 276.95 feet following
2-17 a concrete driveway to a 1/2" iron rod set for an angle point of
2-18 the herein described tract;
2-19 (E) THENCE, N62 30' 47" W, 89.24 feet continuing
2-20 along a concrete driveway to a 1/2" iron rod set on the
2-21 southeasterly right of way line of Bull Creek Road and the
2-22 westernmost corner of the herein described tract;
2-23 (F) THENCE, N26 43' 00" E, 297.55 feet with the
2-24 southeasterly line of Bull Creek Road and the northwesterly line of
2-25 this 2.120 acre tract to the POINT OF BEGINNING AND containing
3-1 2.120 acre (92.350 square feet) of land.
3-2 [(2) bounded on the north by the following
3-3 subdivisions in the City of Austin, Texas:]
3-4 [(A) Shoal Village Section 2, as recorded in
3-5 Plat Book 5, Page 150, of the Plat Records of Travis County,
3-6 Texas;]
3-7 [(B) Shoal Village Section 3, as recorded in
3-8 Plat Book 6, Page 71, of the Plat Records of Travis County, Texas;]
3-9 [(C) Shoal Village Section 5, as recorded in
3-10 Plat Book 6, Page 72, of the Plat Records of Travis County, Texas;]
3-11 [(D) Shoal Village Section 6, as recorded in
3-12 Plat Book 7, Page 7, of the Plat Records of Travis County, Texas;]
3-13 [(E) Shoal Village Section 7, as recorded in
3-14 Plat Book 14, Page 80, of the Plat Records of Travis County, Texas;
3-15 and]
3-16 [(F) Oak Haven Section 3, as recorded in Plat
3-17 Book 11, Page 40, of the Plat Records of Travis County, Texas;]
3-18 SECTION 2. This Act takes effect September 1, 1999.
3-19 SECTION 3. The importance of this legislation and the
3-20 crowded condition of the calendars in both houses create an
3-21 emergency and an imperative public necessity that the
3-22 constitutional rule requiring bills to be read on three several
3-23 days in each house be suspended, and this rule is hereby suspended.
