                                A BILL TO BE ENTITLED
 1-1                                   AN ACT
 1-2     relating to nursing facility bed certification and decertification
 1-3     in the state Medicaid program.
 1-4           BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
 1-5           SECTION 1. Section 32.0213, Human Resources Code, is amended
 1-6     by adding Subsection (c) to read as follows:
 1-7           (c)  The department may provide an exception to the rules
 1-8     established under Subsection (a) for a facility that:
 1-9                 (1)  is affiliated with a state-owned medical school;
1-10                 (2)  is located on land owned or controlled by a
1-11     state-owned medical school; and
1-12                 (3)  serves as a teaching facility for physicians and
1-13     other health care professionals.
1-14           SECTION 2.  If before implementing any provision of this Act
1-15     a state agency determines that a waiver or authorization from a
1-16     federal agency is necessary for implementation of that provision,
1-17     the agency affected by the provision shall request the waiver or
1-18     authorization and may delay implementing that provision until the
1-19     waiver or authorization is granted.
1-20           SECTION 3.  This Act takes effect September 1, 1999.
1-21           SECTION 4.  The importance of this legislation and the
 2-1     crowded condition of the calendars in both houses create an
 2-2     emergency and an imperative public necessity that the
 2-3     constitutional rule requiring bills to be read on three several
 2-4     days in each house be suspended, and this rule is hereby suspended.
