By Edwards H.B. No. 3057 76R9281 JRD-D A BILL TO BE ENTITLED 1-1 AN ACT 1-2 relating to including veterans of certain military conflicts within 1-3 the definition of a historically underutilized business for 1-4 purposes of state contracting. 1-5 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: 1-6 SECTION 1. Section 2161.001, Government Code, is amended by 1-7 amending Subdivision (2) and adding Subdivision (4) to read as 1-8 follows: 1-9 (2) "Historically underutilized business" means: 1-10 (A) a corporation formed for the purpose of 1-11 making a profit in which 51 percent or more of all classes of the 1-12 shares of stock or other equitable securities are owned by one or 1-13 more veterans of military conflict or socially disadvantaged 1-14 persons who have a proportionate interest and actively participate 1-15 in the corporation's control, operation, and management; 1-16 (B) a sole proprietorship created for the 1-17 purpose of making a profit that is completely owned, operated, and 1-18 controlled by a veteran of military conflict or socially 1-19 disadvantaged person; 1-20 (C) a partnership formed for the purpose of 1-21 making a profit in which 51 percent or more of the assets and 1-22 interest in the partnership are owned by one or more veterans of 1-23 military conflict or socially disadvantaged persons who have a 1-24 proportionate interest and actively participate in the 2-1 partnership's control, operation, and management; 2-2 (D) a joint venture in which each entity in the 2-3 venture is a historically underutilized business, as determined 2-4 under another paragraph of this subdivision; or 2-5 (E) a supplier contract between a historically 2-6 underutilized business as determined under another paragraph of 2-7 this subdivision and a prime contractor under which the 2-8 historically underutilized business is directly involved in the 2-9 manufacture or distribution of the goods or otherwise warehouses 2-10 and ships the goods. 2-11 (4) "Veteran of military conflict" means an individual 2-12 who served on active duty in the army, navy, air force, marine 2-13 corps, or coast guard of the United States during the Vietnam 2-14 conflict, the Korean War, or World War II. 2-15 SECTION 2. The importance of this legislation and the 2-16 crowded condition of the calendars in both houses create an 2-17 emergency and an imperative public necessity that the 2-18 constitutional rule requiring bills to be read on three several 2-19 days in each house be suspended, and this rule is hereby suspended, 2-20 and that this Act take effect and be in force from and after its 2-21 passage, and it is so enacted.
