                                A BILL TO BE ENTITLED
 1-1                                   AN ACT
 1-2     relating to funding for cancer research and treatment.
 1-3           BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
 1-4           SECTION 1.  Subchapter G, Chapter 403, Government Code, is
 1-5     amended by adding Section 403.105 to read as follows:
 1-6           Sec. 403.105.  PERMANENT FUND FOR CANCER RESEARCH AND
 1-7     TREATMENT.  (a)  The permanent fund for cancer research and
 1-8     treatment is a  special fund in the state treasury outside the
 1-9     general revenue fund.  The fund is composed of:
1-10                 (1)  money transferred to the fund at the direction of
1-11     the legislature;
1-12                 (2)  gifts and grants contributed to the fund; and
1-13                 (3)  the interest received from investment of money in
1-14     the fund.
1-15           (b)  Except as provided by Subsections (c) and (e), money in
1-16     the fund may not be appropriated for any purpose.
1-17           (c)  The interest received from investment of the fund may be
1-18     appropriated to The University of Texas M. D. Anderson Cancer
1-19     Center to:
1-20                 (1)  conduct research into the causes of and treatments
1-21     for cancer; and
1-22                 (2)  provide cancer treatment for residents of this
1-23     state.
1-24           (d)  Subject to any applicable limit in the General
 2-1     Appropriations Act, The University of Texas M. D. Anderson Cancer
 2-2     Center may contract with another entity to perform all or a part of
 2-3     the functions described by Subsection (c) or may award grants to
 2-4     public or private institutions of higher education  or health care
 2-5     providers to perform all or a part of those functions.  The board
 2-6     of regents of The University of Texas System may adopt rules
 2-7     governing any grant program established under this section.
 2-8           (e)  The comptroller may solicit and accept gifts and grants
 2-9     to the fund.  A gift or grant to the fund may be appropriated in
2-10     the same manner as the interest received from investment of the
2-11     fund, subject to any limitation or requirement placed on the gift
2-12     or grant by the donor or granting entity.
2-13           (f)  Sections 403.095 and 404.071 do not apply to the fund.
2-14           SECTION 2.   On the effective date of this Act, the
2-15     comptroller shall transfer $1,326,075,000 from the general revenue
2-16     fund to the permanent fund for cancer research and treatment
2-17     established by Section 403.105, Government Code, as added by this
2-18     Act.
2-19           SECTION 3.  The importance of this legislation and the
2-20     crowded condition of the calendars in both houses create an
2-21     emergency and an imperative public necessity that the
2-22     constitutional rule requiring bills to be read on three several
2-23     days in each house be suspended, and this rule is hereby suspended,
2-24     and that this Act take effect and be in force from and after its
2-25     passage, and it is so enacted.
