                                A BILL TO BE ENTITLED
 1-1                                   AN ACT
 1-2     relating to the county in which a petition for expunction of
 1-3     certain criminal records and files may be filed.
 1-4           BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
 1-5           SECTION 1.  Section 1(a), Article 55.02, Code of Criminal
 1-6     Procedure, is amended to read as follows:
 1-7           (a)  A person who is entitled to expunction of records and
 1-8     files under this chapter may file an ex parte petition for
 1-9     expunction in a district court for the county in which:
1-10                 (1)  the person [he] was arrested, without regard to
1-11     whether the person was arrested under a warrant of arrest; or
1-12                 (2)  the warrant of arrest was issued if the person was
1-13     arrested under a warrant.
1-14           SECTION 2.  This Act takes effect September 1, 1999.
1-15           SECTION 3.  The importance of this legislation and the
1-16     crowded condition of the calendars in both houses create an
1-17     emergency and an imperative public necessity that the
1-18     constitutional rule requiring bills to be read on three several
1-19     days in each house be suspended, and this rule is hereby suspended.
