A BILL TO BE ENTITLED
1-1 AN ACT
1-2 relating to the minimum salary schedule for certain school district
1-3 employees.
1-4 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1-5 SECTION 1. The heading to Section 21.402, Education Code, is
1-6 amended to read as follows:
1-7 Sec. 21.402. MINIMUM SALARY SCHEDULE [FOR CLASSROOM TEACHERS
1-8 AND FULL-TIME LIBRARIANS].
1-9 SECTION 2. Section 21.402(a), Education Code, is amended to
1-10 read as follows:
1-11 (a) Except as provided by Subsection (d) or (e), a school
1-12 district must pay each classroom teacher, [or] full-time librarian,
1-13 full-time counselor, or full-time registered nurse not less than
1-14 the minimum monthly salary, based on the employee's level of
1-15 experience, determined by the following formula:
1-16 MS = SF X (FSP/ADA)
1-17 where:
1-18 "MS" is the minimum monthly salary;
1-19 "SF" is the applicable salary factor specified by Subsection
1-20 (c);
1-21 "FSP" is the amount appropriated in the General
1-22 Appropriations Act for the fiscal year for the Foundation School
1-23 Program, as determined by the commissioner as provided by
1-24 Subsection (b); and
2-1 "ADA" is the total estimated average daily attendance, as
2-2 defined by Section 42.005, used for purposes of the General
2-3 Appropriations Act for the fiscal year.
2-4 SECTION 3. Sections 21.403(a) and (c), Education Code, are
2-5 amended to read as follows:
2-6 (a) An employee to whom Section 21.402 applies [A teacher or
2-7 librarian] shall advance one step on the minimum salary schedule
2-8 under Section 21.402 for each year of experience [as a teacher or
2-9 librarian] until step 20 is reached.
2-10 (c) The commissioner shall adopt rules for determining the
2-11 experience for which an employee [a teacher or librarian] is to be
2-12 given credit in placing the employee [teacher or librarian] on the
2-13 minimum salary schedule. A district shall credit the employee
2-14 [teacher or librarian] for each year of experience without regard
2-15 to whether the years are consecutive.
2-16 SECTION 4. This Act applies beginning with the 1999-2000
2-17 school year.
2-18 SECTION 5. The importance of this legislation and the
2-19 crowded condition of the calendars in both houses create an
2-20 emergency and an imperative public necessity that the
2-21 constitutional rule requiring bills to be read on three several
2-22 days in each house be suspended, and this rule is hereby suspended,
2-23 and that this Act take effect and be in force from and after its
2-24 passage, and it is so enacted.
