                                A BILL TO BE ENTITLED
 1-1                                   AN ACT
 1-2     relating to authorizing licensed peace officers to utilize computer
 1-3     voice stress analyzers in official criminal investigations.
 1-4           BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
 1-5           SECTION 1.  Section 2, Art. 4413(29cc) of the Polygraph
 1-6     Examiners Act is amended to read as follows:
 1-7           It is the purpose of this Act to regulate all persons who
 1-8     purport to be able to detect deception or to verify truth of
 1-9     statements through the use of instrumentation (as lie detectors,
1-10     polygraphs, deceptographs, and/or similar or related devices and
1-11     instruments without regard to the nomenclature applied thereto) and
1-12     this Act shall be liberally constructed to regulate all such
1-13     persons and instruments except licensed peace officers who are
1-14     certified voice stress analyzer examiners utilizing a computerized
1-15     voice stress analyzer in an official criminal investigation.  No
1-16     person who purports to be able to detect deception or to verify
1-17     truth of statements through instrumentation shall be held exempt
1-18     from the provisions of this Act because of the terminology which he
1-19     may use to refer to himself, to his instrument, or to his services.
1-20           SECTION 2.  The importance of this legislation and the
1-21     crowded condition of the calendars in both houses create an
 2-1     emergency and an imperative public necessity that the
 2-2     constitutional rule requiring bills to be read on three several
 2-3     days in each house be suspended, and this rule is hereby suspended.
