No. 3191 76R6762 SMJ-F A BILL TO BE ENTITLED 1-1 AN ACT 1-2 relating to the imposition of a criminal penalty for a violation of 1-3 a rule concerning the use of county parks. 1-4 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: 1-5 SECTION 1. Section 320.045, Local Government Code, is 1-6 amended to read as follows: 1-7 Sec. 320.045. RULES; PENALTY FOR VIOLATIONS. (a) Subject 1-8 to the approval of the commissioners court, the board may adopt 1-9 reasonable rules concerning the use of any park administered by the 1-10 board. 1-11 (b) A person commits an offense if the person violates a 1-12 board rule adopted under Subsection (a). An offense under this 1-13 subsection is a Class C misdemeanor. 1-14 SECTION 2. This Act takes effect September 1, 1999. 1-15 SECTION 3. The importance of this legislation and the 1-16 crowded condition of the calendars in both houses create an 1-17 emergency and an imperative public necessity that the 1-18 constitutional rule requiring bills to be read on three several 1-19 days in each house be suspended, and this rule is hereby suspended. 1-20 COMMITTEE AMENDMENT NO. 1 1-21 Amend H.B. No. 3191: 1-22 (1) On page 1, line 12, strike "board rule" and substitute 1-23 "rule approved by the commissioners court". 1-24 (2) On page 1, between lines 13 and 14, insert new 2-1 Subsection (c) to read as follows: 2-2 "(c) Fines collected under Subsection (b) shall be deposited 2-3 in the county's general fund." 2-4 Swinford
