1-1 AN ACT
1-2 relating to contraband subject to seizure under a search warrant.
1-3 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1-4 SECTION 1. Article 18.01(d), Code of Criminal Procedure, is
1-5 amended to read as follows:
1-6 (d) Only the specifically described property or items set
1-7 forth in a search warrant issued under Subdivision (10) of Article
1-8 18.02 of this code or property, [or] items or contraband enumerated
1-9 in Subdivisions (1) through (9) or in Subdivision (12) of Article
1-10 18.02 of this code may be seized. A subsequent search warrant may
1-11 be issued pursuant to Subdivision (10) of Article 18.02 of this
1-12 code to search the same person, place, or thing subjected to a
1-13 prior search under Subdivision (10) of Article 18.02 of this code
1-14 only if the subsequent search warrant is issued by a judge of a
1-15 district court, a court of appeals, the court of criminal appeals,
1-16 or the supreme court.
1-17 SECTION 2. The importance of this legislation and the
1-18 crowded condition of the calendars in both houses create an
1-19 emergency and an imperative public necessity that the
1-20 constitutional rule requiring bills to be read on three several
1-21 days in each house be suspended, and this rule is hereby suspended,
1-22 and that this Act take effect and be in force from and after its
1-23 passage, and it is so enacted.
