                                A BILL TO BE ENTITLED
 1-1                                   AN ACT
 1-2     relating to the property, items, persons, or contraband subject to
 1-3     seizure under a search warrant.
 1-4           BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
 1-5           SECTION 1.  Article 18.01(d), Code of Criminal Procedure, is
 1-6     amended to read as follows:
 1-7           (d)  Only the specifically described property, [or] items,
 1-8     persons, or contraband set forth and described in a search warrant
 1-9     issued under [Subdivision (10) of] Article 18.02 of this code [or
1-10     property or items enumerated in Subdivisions (1) through (9) of
1-11     Article 18.02 of this code] may be seized.  A subsequent search
1-12     warrant may be issued pursuant to Subdivision (10) of Article 18.02
1-13     of this code to search the same person, place, or thing subjected
1-14     to a prior search under Subdivision (10) of Article 18.02 of this
1-15     code only if the subsequent search warrant is issued by a judge of
1-16     a district court, a court of appeals, the court of criminal
1-17     appeals, or the supreme court.
1-18           SECTION 2.  The importance of this legislation and the
1-19     crowded condition of the calendars in both houses create an
1-20     emergency and an imperative public necessity that the
1-21     constitutional rule requiring bills to be read on three several
1-22     days in each house be suspended, and this rule is hereby suspended,
1-23     and that this Act take effect and be in force from and after its
1-24     passage, and it is so enacted.
