 1-6                            A BILL TO BE ENTITLED
 1-7                                   AN ACT
 1-8     relating to the property, items, persons, or contraband subject to
 1-9     seizure under a search warrant.
1-10           BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1-11           SECTION 1.  Article 18.01(d), Code of Criminal Procedure, is
1-12     amended to read as follows:
1-13           (d)  Only the specifically described property or items set
1-14     forth in a search warrant issued under Subdivision (10) of Article
1-15     18.02 of this code or property, [or] items, persons, or contraband
1-16     enumerated in Subdivisions (1) through (9), (11), or (12) of
1-17     Article 18.02 of this code may be seized.  A subsequent search
1-18     warrant may be issued pursuant to Subdivision (10) of Article 18.02
1-19     of this code to search the same person, place, or thing subjected
1-20     to a prior search under Subdivision (10) of Article 18.02 of this
1-21     code only if the subsequent search warrant is issued by a judge of
1-22     a district court, a court of appeals, the court of criminal
1-23     appeals, or the supreme court.
1-24           SECTION 2.  The importance of this legislation and the
1-25     crowded condition of the calendars in both houses create an
1-26     emergency and an imperative public necessity that the
1-27     constitutional rule requiring bills to be read on three several
1-28     days in each house be suspended, and this rule is hereby suspended,
1-29     and that this Act take effect and be in force from and after its
1-30     passage, and it is so enacted.
