                                A BILL TO BE ENTITLED
 1-1                                   AN ACT
 1-2     relating to Election Code violations; providing penalties.
 1-3           BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
 1-4           SECTION 1.  Chapter 276, Election Code, is amended by adding
 1-5     Section 276.002 to read as follows:
 1-6           Sec. 276.002.  ELECTION CODE VIOLATION OR FAILURE TO PERFORM
 1-7     A DUTY PLACED BY THIS CODE.  (a)  A person commits an offense if
 1-8     the person violates any section of this code or fails to perform a
 1-9     duty placed by this code on the person.  This section does not
1-10     supercede penalties imposed by any other section of this or any
1-11     other code.
1-12           (b)  An offense under this section is:
1-13                 (1)  a Class C misdemeanor if the conduct is performed
1-14     recklessly or with criminal negligence; or
1-15                 (2)  a Class A misdemeanor if the conduct is performed
1-16     knowingly.
1-17           SECTION 2.  This Act takes effect September 1, 1999.
1-18           SECTION 3.  The importance of this legislation and the
1-19     crowded condition of the calendars in both houses create an
1-20     emergency and an imperative public necessity that the
1-21     constitutional rule requiring bills to be read on three several
 2-1     days in each house be suspended, and this rule is hereby suspended.
