                                A BILL TO BE ENTITLED
 1-1                                   AN ACT
 1-2     relating to the election of the governing board of certain junior
 1-3     college districts.
 1-4           BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
 1-5           SECTION 1.  Subchapter E, Chapter 130, Education Code, is
 1-6     amended by adding Section 130.0823 to read as follows:
 1-7           Sec. 130.0823.  ELECTION BY POSITION IN CERTAIN DISTRICTS.
 1-8     (a)  This section applies to a junior college that elects a
 1-9     governing board of seven members, with four members elected from
1-10     respective commissioner precincts and three members elected at
1-11     large.
1-12           (b)  The governing board of the junior college may order that
1-13     the board members elected at large be elected instead by position.
1-14     The order must be entered not later than the 120th day before the
1-15     first election of a trustee by position.
1-16           (c)  The board may provide for trustees holding office on the
1-17     date of the initial election of trustees by position to serve the
1-18     remainder of their terms and to represent a position for that term.
1-19           SECTION 2.  The importance of this legislation and the
1-20     crowded condition of the calendars in both houses create an
1-21     emergency and an imperative public necessity that the
1-22     constitutional rule requiring bills to be read on three several
1-23     days in each house be suspended, and this rule is hereby suspended.
