 1-7                                   AN ACT
 1-8     relating to the election of the governing board of certain junior
 1-9     college districts.
1-10           BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1-11           SECTION 1.  Subchapter E, Chapter 130, Education Code, is
1-12     amended by adding Section 130.0823 to read as follows:
1-13           Sec. 130.0823.  ELECTION BY POSITION IN CERTAIN DISTRICTS.
1-14     (a)  This section applies to a junior college that elects a
1-15     governing board of seven members, with four members elected from
1-16     respective commissioner precincts and three members elected at
1-17     large.
1-18           (b)  The governing board of the junior college may order that
1-19     the board members elected at large be elected instead by position.
1-20     The order must be entered not later than the 120th day before the
1-21     first election of a trustee by position.
1-22           (c)  The board may provide for trustees holding office on the
1-23     date of the initial election of trustees by position to serve the
1-24     remainder of their terms and to represent a position for that term.
1-25           SECTION 2.  The importance of this legislation and the
1-26     crowded condition of the calendars in both houses create an
1-27     emergency and an imperative public necessity that the
1-28     constitutional rule requiring bills to be read on three several
1-29     days in each house be suspended, and this rule is hereby suspended.
