No. 3265 1-2 (In the Senate - Received from the House May 5, 1999; 1-3 May 6, 1999, read first time and referred to Committee on 1-4 Administration; May 14, 1999, reported favorably, as amended, by 1-5 the following vote: Yeas 5, Nays 0; May 14, 1999, sent to 1-6 printer.) 1-7 COMMITTEE AMENDMENT NO. 1 By: Madla 1-8 Amend H.B. 3265 as follows: 1-9 (1) On page 1, line 18 strike "For" and substitute "Except 1-10 as required by Section 264.514, Family Code, for". 1-11 A BILL TO BE ENTITLED 1-12 AN ACT 1-13 relating to the duties of a justice of the peace with respect to 1-14 inquests on dead bodies. 1-15 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: 1-16 SECTION 1. Article 49.10(c), Code of Criminal Procedure, is 1-17 amended to read as follows: 1-18 (c) For each body that is the subject of an inquest by a 1-19 justice of the peace, the justice, in the justice's discretion, 1-20 shall: 1-21 (1) direct a physician to perform an autopsy; or 1-22 (2) certify that no autopsy is necessary. 1-23 SECTION 2. The importance of this legislation and the 1-24 crowded condition of the calendars in both houses create an 1-25 emergency and an imperative public necessity that the 1-26 constitutional rule requiring bills to be read on three several 1-27 days in each house be suspended, and this rule is hereby suspended, 1-28 and that this Act take effect and be in force from and after its 1-29 passage, and it is so enacted. 1-30 * * * * *
