1-6 A BILL TO BE ENTITLED
1-7 AN ACT
1-8 relating to the exclusion of certain sewage sludge from solid waste
1-9 disposal fees.
1-10 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1-11 SECTION 1. Section 361.013(i), Health and Safety Code, is
1-12 amended to read as follows:
1-13 (i) The commission may not charge a fee under Subsection (a)
1-14 for the disposal of:
1-15 (1) [the disposal of] Class I industrial solid waste
1-16 or hazardous waste subject to the assessment of fees under Section
1-17 361.136; [or]
1-18 (2) [the disposal of] an industrial solid waste for
1-19 which no permit may be required under Section 361.090; or
1-20 (3) sewage sludge that:
1-21 (A) has been treated to reduce the density of
1-22 pathogens to the lowest level provided by commission rules; and
1-23 (B) complies with commission rules regarding:
1-24 (i) metal concentration limits;
1-25 (ii) pathogen reduction; and
1-26 (iii) vector attraction reduction.
1-27 SECTION 2. This Act takes effect September 1, 1999.
1-28 SECTION 3. The importance of this legislation and the
1-29 crowded condition of the calendars in both houses create an
1-30 emergency and an imperative public necessity that the
1-31 constitutional rule requiring bills to be read on three several
1-32 days in each house be suspended, and this rule is hereby suspended.
