                                A BILL TO BE ENTITLED
 1-1                                   AN ACT
 1-2     relating to the creation of a state registry of certain adult
 1-3     day-care workers.
 1-4           BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
 1-5           SECTION 1.  Chapter 103, Human Resources Code, is amended by
 1-6     adding Section 103.012 to read as follows:
 1-7           Sec. 103.012.  REGISTRY OF ADULT DAY-CARE WORKERS.  (a)  The
 1-8     department shall establish a state registry to contain the names of
 1-9     adult day-care workers determined to have abused, neglected, or
1-10     exploited a person receiving services at an adult day-care facility
1-11     or under an adult day-care program.
1-12           (b)  In establishing the state registry, the department shall
1-13     provide for:
1-14                 (1)  due process rights of an adult day-care worker in
1-15     connection with placement of the worker's name in the registry; and
1-16                 (2)  public access to the registry.
1-17           (c)  The department shall adopt rules as necessary to
1-18     implement this section.
1-19           SECTION 2.  The importance of this legislation and the
1-20     crowded condition of the calendars in both houses create an
1-21     emergency and an imperative public necessity that the
1-22     constitutional rule requiring bills to be read on three several
1-23     days in each house be suspended, and this rule is hereby suspended,
1-24     and that this Act take effect and be in force from and after its
 2-1     passage, and it is so enacted.
