                                A BILL TO BE ENTITLED
 1-1                                   AN ACT
 1-2     relating to explaining services provided by adult day care and
 1-3     adult day health care facilities to applicants for those services.
 1-4           BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
 1-5           SECTION 1.  Chapter 103, Human Resources Code, is amended by
 1-6     adding Section 103.012 to read as follows:
 1-7           Sec. 103.012.  EXPLANATION OF AVAILABLE SERVICES.  (a)  The
 1-8     department by rule shall develop and implement a program to train
 1-9     department employees whose employment responsibilities include
1-10     explaining services provided by an adult day care facility or an
1-11     adult day health care facility to effectively explain those
1-12     services to an applicant or an applicant's guardian.
1-13           (b)  The department shall require a department employee
1-14     described by Subsection (a) to provide proof that the services were
1-15     explained to an applicant or the applicant's guardian.  The proof
1-16     must be provided in the manner determined by the department.
1-17           SECTION 2.  Not later than January 1, 2000, the Texas
1-18     Department of Human Services shall develop and implement the
1-19     training program required by Section 103.012, Human Resources Code,
1-20     as added by this Act.
1-21           SECTION 3.  This Act takes effect September 1, 1999.
1-22           SECTION 4.  The importance of this legislation and the
1-23     crowded condition of the calendars in both houses create an
1-24     emergency and an imperative public necessity that the
 2-1     constitutional rule requiring bills to be read on three several
 2-2     days in each house be suspended, and this rule is hereby suspended.
