                                A BILL TO BE ENTITLED
 1-1                                   AN ACT
 1-2     relating to registration and operation of certain farm vehicles and
 1-3     trailers.
 1-4           BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
 1-5           SECTION 1.  Section 502.163(b), Transportation Code, is
 1-6     amended to read as follows:
 1-7           (b)  A commercial motor vehicle may be registered under this
 1-8     section despite:
 1-9                 (1)  its use for transporting without charge the owner
1-10     or a member of the owner's family:
1-11                       (A) [(1)]  to attend church or school;
1-12                       (B) [(2)]  to visit a doctor for medical
1-13     treatment or supplies; or
1-14                       (C) [(3)]  for other necessities of the home or
1-15     family; or
1-16                 (2)  the occasional use of the vehicle without charge
1-17     by a person other than the owner for an activity described by this
1-18     section.
1-19           SECTION 2.  Section 502.276(c), Transportation Code, is
1-20     amended to read as follows:
1-21           (c)  A vehicle that has [An owner who obtains] a
1-22     distinguishing license plate issued under Subsection (b) may be
1-23     operated [operate] temporarily on the highways if the vehicle is:
1-24                 (1)  a farm trailer or farm semitrailer with a gross
 2-1     weight of more than 4,000 pounds but not more than 34,000 pounds
 2-2     that is used exclusively to transport:
 2-3                       (A)  [the owner's] seasonally harvested
 2-4     agricultural products or [and] livestock from the place of
 2-5     production to the place of processing, market, or storage; or
 2-6                       (B)  farm supplies from the place of loading to
 2-7     the farm;
 2-8                 (2)  machinery used exclusively for the purpose of
 2-9     drilling water wells; or
2-10                 (3)  construction machinery that is not designed to
2-11     transport persons or property on a public highway.
2-12           SECTION 3.  The importance of this legislation and the
2-13     crowded condition of the calendars in both houses create an
2-14     emergency and an imperative public necessity that the
2-15     constitutional rule requiring bills to be read on three several
2-16     days in each house be suspended, and this rule is hereby suspended,
2-17     and that this Act take effect and be in force from and after its
2-18     passage, and it is so enacted.
