A BILL TO BE ENTITLED 1-1 AN ACT 1-2 relating to the use and distribution of dietary supplements in 1-3 public schools. 1-4 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: 1-5 SECTION 1. Chapter 38, Education Code, is amended by adding 1-6 Section 38.011 to read as follows: 1-7 Section 38.011 DIETARY SUPPLEMENTS. 1-8 Sec. 1. DEFINITIONS. In this section, "dietary supplement" 1-9 has the meaning assigned by the Food and Drug Administration, 21 1-10 U.S.C. Section 321 (ff). 1-11 Sec. 2. PROHIBITED ACTS. (a) A school district employee 1-12 may not sell, market, or distribute any dietary supplement to a 1-13 student. 1-14 (b) A school district employee may not endorse or suggest 1-15 the ingestion of any dietary supplement that has not been evaluated 1-16 and approved for safety by the United States Food and Drug 1-17 Administration. 1-18 SECTION 3. This Act takes effect September 1, 1999. 1-19 SECTION 4. The importance of this legislation and the 1-20 crowded condition of the calendars in both houses create an 1-21 emergency and an imperative public necessity that the 2-1 constitutional rule requiring bills to be read on three several 2-2 days in each house be suspended, and this rule is hereby suspended.
