                                A BILL TO BE ENTITLED
 1-1                                   AN ACT
 1-2     relating to the effect on a period of community supervision  of the
 1-3     issuance of a capias or warrant alleging a violation of a condition
 1-4     of community supervision.
 1-5           BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
 1-6           SECTION 1.  Section 21, Article 42.12, Code of Criminal
 1-7     Procedure, is amended by adding Subsection (e) to read as follows:
 1-8           (e)  The issuance of a capias or warrant for violation of a
 1-9     condition of community supervision tolls the period of supervision
1-10     from the date of  issuance until the date the hearing under
1-11     Subsection (b) begins.
1-12           SECTION 2.   The change in law made by this Act applies only
1-13     to a capias or warrant issued on or after the effective date of
1-14     this Act.  A capias or warrant issued before the effective date of
1-15     this Act is covered by the law in effect when the capias or warrant
1-16     was issued, and the former law is continued in effect for that
1-17     purpose.
1-18           SECTION 3.  This Act takes effect September 1, 1999.
1-19           SECTION 4.  The importance of this legislation and the
1-20     crowded condition of the calendars in both houses create an
1-21     emergency and an imperative public necessity that the
1-22     constitutional rule requiring bills to be read on three several
1-23     days in each house be suspended, and this rule is hereby suspended.
