                                A BILL TO BE ENTITLED
 1-1                                   AN ACT
 1-2     relating to minimum area, attendance and election requirements for
 1-3     creation of a new school district.
 1-4           BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
 1-5           SECTION 1.  Chapter 13.102, Education Code, is amended to
 1-6     read as follows:
 1-7           A new district may not be created with an area of less than
 1-8     250 [nine] square miles or fewer than 10,000 [8,000] students in
 1-9     average daily attendance, and a district may not be reduced to an
1-10     area of less than 250 [nine] square miles or fewer than 10,000
1-11     [8,000] students in average daily attendance.
1-12           SECTION 2.  Chapter 13.104(c), Education Code, is amended to
1-13     read as follows:
1-14           An election on the detachment of the territory and creation
1-15     of a new district has no effect unless at least ten [25] percent of
1-16     the registered voters of each district vote in the election in
1-17     which the issue is on the ballot.
1-18           SECTION 3.  The importance of this legislation and the
1-19     crowded condition of the calendars in both houses create an
1-20     emergency and an imperative public necessity that the
1-21     constitutional rule requiring bills to be read on three several
 2-1     days in each house be suspended, and this rule is hereby suspended,
 2-2     and that this Act take effect and be in force from and after its
 2-3     passage, and it is so enacted.
