No. 3467 76R6148 DRH-D A BILL TO BE ENTITLED 1-1 AN ACT 1-2 relating to the disposition of the proceeds of fines collected for 1-3 overweight vehicles. 1-4 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: 1-5 SECTION 1. Section 621.506(g), Transportation Code, is 1-6 amended to read as follows: 1-7 (g) A governmental entity that collects a fine under this 1-8 section for an offense involving a vehicle having a gross weight 1-9 that is more than 5,000 pounds heavier than the vehicle's allowable 1-10 gross weight shall send an amount equal to 50 percent of the fine 1-11 to the comptroller unless the offense occurred within 20 miles of 1-12 an international border in which event the entire amount of the 1-13 fine shall be deposited in: 1-14 (1) the municipal treasury, if the fine was imposed by 1-15 a municipal court; or 1-16 (2) the county treasury, if the fine was imposed by a 1-17 justice court. 1-18 SECTION 2. The change in law made by this Act to Section 1-19 621.506(g), Transportation Code, applies only to a fine collected 1-20 on or after the effective date of this Act, regardless of whether 1-21 the offense for which the fine is collected occurred before, on, or 1-22 after the effective date of this Act. 1-23 SECTION 3. This Act takes effect September 1, 1999. 1-24 SECTION 4. The importance of this legislation and the 2-1 crowded condition of the calendars in both houses create an 2-2 emergency and an imperative public necessity that the 2-3 constitutional rule requiring bills to be read on three several 2-4 days in each house be suspended, and this rule is hereby suspended.
