                                A BILL TO BE ENTITLED
 1-1                                   AN ACT
 1-2     relating to the issuance of certain citations to public school
 1-3     students.
 1-4           BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
 1-5           SECTION 1.  Subchapter C, Chapter 37, Education Code, is
 1-6     amended by adding Section 37.0811 to read as follows:
 1-7           Sec. 37.0811.  ISSUANCE OF CERTAIN CITATIONS PROHIBITED.
 1-8     Notwithstanding any other provision of this chapter, a school
 1-9     district peace officer or other peace officer may not issue a
1-10     citation to a student for disruptive behavior, including a
1-11     violation of a student code of conduct, if the student's behavior
1-12     is not punishable under the Penal Code.
1-13           SECTION 2.  This Act takes effect September 1, 1999.
1-14           SECTION 3.  (a)  The change in law made by this Act applies
1-15     only to an offense committed on or after September 1, 1999. For the
1-16     purposes of this section, an offense is committed before September
1-17     1, 1999, if any element of the offense occurs before the effective
1-18     date.
1-19           (b)  An offense committed before September 1, 1999, is
1-20     covered by the law in effect when the offense was committed, and
1-21     the former law is continued in effect for that purpose.
1-22           SECTION 4.  The importance of this legislation and the
1-23     crowded condition of the calendars in both houses create an
1-24     emergency and an imperative public necessity that the
 2-1     constitutional rule requiring bills to be read on three several
 2-2     days in each house be suspended, and this rule is hereby suspended.
