1-8 On page 1, between Line 49 and Line 50, insert the following:
1-9 "(d) The provisions of Section 49.056(c), Water Code, do not apply
1-10 to the District."
1-11 A BILL TO BE ENTITLED
1-12 AN ACT
1-13 relating to the board of directors and the validation of certain
1-14 acts of the Bexar-Medina-Atascosa Counties Water Control and
1-15 Improvement District No. 1.
1-16 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1-17 SECTION 1. Sections 2(c) and (e), Chapter 544, Acts of the
1-18 74th Legislature, Regular Session, 1995, are amended to read as
1-19 follows:
1-20 (c) At the board election held on the first Saturday in May
1-21 of 1996, five directors shall be elected. One director shall be
1-22 elected from each of single-member precincts numbers two [one],
1-23 three, and four [five]. Two directors shall be elected from the
1-24 district at large. A director whose term expires in 1996 may seek
1-25 election to an at-large position or a single-member position for
1-26 which the director qualifies.
1-27 (e) At the board election held on the first Saturday in May
1-28 of 1998, one director shall be elected from each of single-member
1-29 precincts numbers one [two] and five [four] to serve four-year
1-30 terms. One director shall be elected from the district at large to
1-31 serve a four-year term. A director whose term expires in 1998 may
1-32 seek election to a vacant at-large position or a single-member
1-33 precinct position for which the director qualifies.
1-34 SECTION 2. (a) All governmental acts and proceedings of the
1-35 district not excepted by this Act are validated as of the dates on
1-36 which they occurred. This validation includes the validation of a
1-37 governmental act or proceeding relating to the election of board
1-38 members for the district.
1-39 (b) This Act does not validate any governmental acts or
1-40 proceedings that were void or which, under the statutes of this
1-41 state at the time the actions or proceedings occurred, were a
1-42 misdemeanor or felony.
1-43 (c) This Act does not apply to a matter that on the
1-44 effective date of this Act:
1-45 (1) is involved in litigation if the litigation
1-46 ultimately results in the matter being held invalid by a final
1-47 judgment of a court of competent jurisdiction; or
1-48 (2) has been held invalid by a final judgment of a
1-49 court of competent jurisdiction.
1-50 SECTION 3. The importance of this legislation and the
1-51 crowded condition of the calendars in both houses create an
1-52 emergency and an imperative public necessity that the
1-53 constitutional rule requiring bills to be read on three several
1-54 days in each house be suspended, and this rule is hereby suspended,
1-55 and that this Act take effect and be in force from and after its
1-56 passage, and it is so enacted.
