By McClendon, Oliveira, Luna, Keffer, H.B. No. 3596 A BILL TO BE ENTITLED 1-1 AN ACT 1-2 relating to workforce development services provided by the Texas 1-3 Workforce Commission or a private vendor under a contract with a 1-4 local workforce development board. 1-5 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: 1-6 SECTION 1. Section 2308.303, Government Code, is amended by 1-7 adding Subsection (e) to read as follows: 1-8 (e) Except as otherwise provided by this subsection, a local 1-9 workforce development board shall enter into contracts with private 1-10 vendors for the provision of workforce development services, 1-11 including any service the provision of which is delegated to the 1-12 board under Section 302.023, Labor Code. However, if a private 1-13 vendor is unavailable, or if the contracts submitted by private 1-14 vendors to provide services are not acceptable to the board, the 1-15 board may contract with the Texas Workforce Commission for the 1-16 provision of a workforce development service or to administer the 1-17 competitive procurement process. 1-18 SECTION 2. Section 302.002, Labor Code, is amended by adding 1-19 Subsection (f) to read as follows: 1-20 (f) The executive director may contract with local workforce 1-21 development boards as necessary to implement Section 2308.303, 1-22 Government Code. 1-23 SECTION 3. This Act takes effect September 1, 1999. 1-24 SECTION 4. The importance of this legislation and the 1-25 crowded condition of the calendars in both houses create an 2-1 emergency and an imperative public necessity that the 2-2 constitutional rule requiring bills to be read on three several 2-3 days in each house be suspended, and this rule is hereby suspended.
