 1-6                            A BILL TO BE ENTITLED
 1-7                                   AN ACT
 1-8     relating to the exchange and conveyance of lands by certain
 1-9     navigation districts.
1-10           BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1-11           SECTION 1.  Section 1, Chapter 176, Acts of the 54th
1-12     Legislature, Regular Session, 1955 (Article 8247f, Vernon's Texas
1-13     Civil Statutes), is amended to read as follows:
1-14           Sec. 1.  The Governing Board of any navigation district in
1-15     this State heretofore or hereafter created under the laws of this
1-16     State [and having within its limits a city containing two hundred
1-17     and fifty thousand (250,000) population or more according to the
1-18     latest preceding or any future Federal Census] shall have and there
1-19     is hereby conferred the right, power and authority, when in the
1-20     opinion of a majority of said Governing Board it is necessary,
1-21     desirable or advantageous to the interest of said navigation
1-22     district so to do, to exchange lands with any other public or
1-23     private landowner, or, as an incident to the acquisition of lands
1-24     for the uses and purposes of said navigation district, to make
1-25     conveyance to another state or federal governmental entity, person,
1-26     firm or corporation of lands owned and held by said navigation
1-27     district the ownership and use of which was no longer necessary or
1-28     desirable or the use of which lands was not as feasible or
1-29     desirable for the public purposes of said navigation district as is
1-30     and as will be the lands to be acquired by said navigation
1-31     district, in accordance with any terms, conditions, or stipulations
1-32     agreed on by the parties to the exchange or conveyance.
1-33           SECTION 2.  Section 1 of this Act does not:
1-34                 (1)  affect a limitation or condition contained in:
1-35                       (A)  a lease of land by the state to a navigation
1-36     district; or
1-37                       (B)  a conveyance of land from the state to a
1-38     navigation district under former Article 8225, Revised Statutes, or
1-39     any other general or special law; or
1-40                 (2)  in any way affect Section 61.116 or 61.117, Water
1-41     Code.
1-42           SECTION 3.  The importance of this legislation and the
1-43     crowded condition of the calendars in both houses create an
1-44     emergency and an imperative public necessity that the
1-45     constitutional rule requiring bills to be read on three several
1-46     days in each house be suspended, and this rule is hereby suspended,
1-47     and that this Act take effect and be in force from and after its
1-48     passage, and it is so enacted.
