                                A BILL TO BE ENTITLED
 1-1                                   AN ACT
 1-2     relating to the imposition of an aquatics center fee at The
 1-3     University of Texas at Austin.
 1-4           BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
 1-5           SECTION 1.  Subchapter E, Chapter 54, Education Code, is
 1-6     amended by adding Section 54.5372 to read as follows:
 1-7           Sec. 54.5372.  AQUATICS CENTER FEE;  THE UNIVERSITY OF TEXAS
 1-8     AT AUSTIN.  (a)  The board of regents of The University of Texas
 1-9     System may impose a fee on each student enrolled at The University
1-10     of Texas at Austin in an amount not to exceed $.85 per semester
1-11     credit hour for financing, constructing, renovating, operating,
1-12     maintaining, and improving an Aquatics Center at the Gregory
1-13     Gymnasium Complex.
1-14           (b)  The board of regents shall prorate the fee imposed under
1-15     this section based on the length of the semester or term for which
1-16     the student is enrolled.
1-17           (c)  A fee may not be imposed under this section until the
1-18     first semester in which the Aquatics Center is made available for
1-19     use.
1-20           (d)  The board of regents may pledge revenue from the fee
1-21     imposed under this section for the payment of obligations issued
1-22     for authorized purposes pursuant to the revenue financing system of
1-23     The University of Texas System.
1-24           (e)  A fee imposed under this section may not be counted in
 2-1     determining the maximum student services fee that may be imposed on
 2-2     students of The University of Texas at Austin under this
 2-3     subchapter.
 2-4           SECTION 2.  This Act takes effect beginning with the 1999
 2-5     fall semester.
 2-6           SECTION 3.  The importance of this legislation and the
 2-7     crowded condition of the calendars in both houses create an
 2-8     emergency and an imperative public necessity that the
 2-9     constitutional rule requiring bills to be read on three several
2-10     days in each house be suspended, and this rule is hereby suspended,
2-11     and that this Act take effect and be in force from and after its
2-12     passage, and it is so enacted.
