 1-7                                   AN ACT
 1-8     relating to service credit under the Teacher Retirement System of
 1-9     Texas for certain work experience of certified career and
1-10     technology education teachers.
1-11           BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1-12           SECTION 1.  Subchapter E, Chapter 823, Government Code, is
1-13     amended by adding Section 823.404 to read as follows:
1-14           Sec. 823.404.  WORK EXPERIENCE BY CAREER OR TECHNOLOGY
1-15     TEACHER.  (a)  An eligible member may establish equivalent
1-16     membership service credit for one or two years of work experience
1-17     for which the member is entitled to salary step credit under
1-18     Section 21.403(b), Education Code.
1-19           (b)  A member is eligible to establish equivalent membership
1-20     service credit under this section if the member has at least five
1-21     years of membership service credit.
1-22           (c)  A member may establish credit under this section by
1-23     depositing with the retirement system, for each year of service,
1-24     the actuarial present value, at the time of deposit, of the
1-25     additional standard retirement annuity benefits that would be
1-26     attributable to the conversion of the work experience into service
1-27     credit based on rates and tables recommended by the actuary and
1-28     adopted by the board of trustees.
1-29           (d)  After a member makes the deposits required by this
1-30     section, the retirement system shall grant the member one year of
1-31     equivalent membership service credit for each year of service
1-32     approved.
1-33           SECTION 2.  Section 823.004(a), Government Code, is amended
1-34     to read as follows:
1-35           (a)  All credit for military service, out-of-state service,
1-36     developmental leave, service previously waived, work experience in
1-37     a career or technological field, and service transferred to the
1-38     retirement system under Chapter 805 shall be computed on a
1-39     September 1 through August 31 school year.  Payments for service
1-40     described by this section must be completed not later than the
1-41     later of the member's retirement date or the last day of the month
1-42     in which the member submits a retirement application.
1-43           SECTION 3.  Section 825.307(a), Government Code, is amended
1-44     to read as follows:
1-45           (a)  The retirement system shall deposit in a member's
1-46     individual account in the member savings account:
1-47                 (1)  the amount of contributions to the retirement
1-48     system that is deducted from the member's compensation;
1-49                 (2)  the portion of a deposit made on or after
1-50     resumption of membership that represents the amount of retirement
1-51     benefits received;
1-52                 (3)  the portion of a deposit to reinstate service
1-53     credit previously canceled that represents the amount withdrawn or
1-54     refunded;
1-55                 (4)  the portion of a deposit to establish membership
1-56     service credit previously waived that is required by Section
1-57     823.202(b)(1);
1-58                 (5)  the portion of a deposit to establish membership
1-59     service credit for service performed after retirement that is
1-60     required by Section 823.502(c)(3) [or (c)(5)];
1-61                 (6)  the portion of a deposit to establish military
1-62     service credit required by Section 823.302(c);
1-63                 (7)  the portion of a deposit to establish equivalent
1-64     membership service credit required by Section 823.401(d),
 2-1     823.402(e)(1) or (e)(2), 823.404(c), or 823.3021(f)(1); and
 2-2                 (8)  interest earned on money in the account as
 2-3     provided by Subsections (b) and (c) and Section 825.313(b)(1).
 2-4           SECTION 4.  This Act takes effect September 1, 1999.
 2-5           SECTION 5.  The importance of this legislation and the
 2-6     crowded condition of the calendars in both houses create an
 2-7     emergency and an imperative public necessity that the
 2-8     constitutional rule requiring bills to be read on three several
 2-9     days in each house be suspended, and this rule is hereby suspended.
