                                A BILL TO BE ENTITLED
 1-1                                   AN ACT
 1-2     relating to the regulation of the use of laser pointers; providing
 1-3     criminal penalties.
 1-4           BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
 1-5           SECTION 1.  Subtitle A, Title 9, Health and Safety Code, is
 1-6     amended by adding Chapter 761 to read as follows:
 1-7                 CHAPTER 761.  REGULATION OF LASER POINTERS
 1-8           Sec. 761.001.  DEFINITIONS.  In this chapter:
 1-9                 (1)  "Laser Pointer" means a device that emits a
1-10     visible light amplified by the stimulated emission of radiation.
1-11           Sec. 761.004.  DIRECTING LIGHT AT CERTAIN INDIVIDUALS.  (a)
1-12     A person commits an offense if the person directs light from a
1-13     laser pointer at a uniformed police officer, or other uniformed
1-14     city, state, or federal peace officer, or the marked service
1-15     vehicle of any such individual.
1-16           (b)  An offense under this section is a Class B misdemeanor.
1-17           SECTION 2.  This Act takes effect September 1, 1999.
1-18           SECTION 3.  The importance of this legislation and the
1-19     crowded condition of the calendars in both houses create an
1-20     emergency and an imperative public necessity that the
1-21     constitutional rule requiring bills to be read on three several
 2-1     days in each house be suspended, and this rule is hereby suspended.
