No. 3693 as follows: 1-8 (1) Between SECTION 1 and SECTION 2 of the bill (House 1-9 engrossment, page 1, between lines 48 and 49), add the following 1-10 new SECTION: 1-11 SECTION 2. (a) Notwithstanding Section 32.0213, Human 1-12 Resources Code, as amended by this Act, or any other law relating 1-13 to certification of Medicaid beds in nursing facilities, a person 1-14 is not subject to any limitation controlling the number of Medicaid 1-15 beds in nursing facilities and is entitled to contract with the 1-16 appropriate state agency to participate in the state Medicaid 1-17 program and provide beds in a nursing facility if the person: 1-18 (1) holds a state waiver from the limitation on the 1-19 number of Medicaid beds that: 1-20 (A) was issued before May 1, 1999; and 1-21 (B) authorizes the operation of a 150-bed 1-22 nursing facility; 1-23 (2) locates the nursing facility in a municipality 1-24 with a population of more than 900,000; 1-25 (3) begins construction of the nursing facility not 1-26 later than December 1, 1999; and 1-27 (4) meets all requirements for licensure and 1-28 certification. 1-29 (b) Subsection (a) of this section authorizes a person to 1-30 contract to provide only the number of Medicaid beds specified in 1-31 the person's waiver described by Subsection (a)(1) of this section. 1-32 (2) In SECTION 2 of the bill (House engrossment, page 1, 1-33 line 49), strike "2" and substitute "3". 1-34 A BILL TO BE ENTITLED 1-35 AN ACT 1-36 relating to certification under the state Medicaid program of 1-37 nursing home beds in certain nursing facilities. 1-38 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: 1-39 SECTION 1. Section 32.0213, Human Resources Code, is amended 1-40 by adding Subsection (c) to read as follows: 1-41 (c) The department may exempt a nursing facility from the 1-42 procedures established under this section if the facility: 1-43 (1) is affiliated with a state-supported medical 1-44 school; 1-45 (2) is located on land owned or controlled by the 1-46 state-supported medical school; and 1-47 (3) serves as a teaching facility for physicians and 1-48 related health care professionals. 1-49 SECTION 2. The importance of this legislation and the 1-50 crowded condition of the calendars in both houses create an 1-51 emergency and an imperative public necessity that the 1-52 constitutional rule requiring bills to be read on three several 1-53 days in each house be suspended, and this rule is hereby suspended, 1-54 and that this Act take effect and be in force from and after its 1-55 passage, and it is so enacted. 1-56 * * * * *
