                                A BILL TO BE ENTITLED
 1-1                                   AN ACT
 1-2     relating to the requirement for the name, address and phone number
 1-3     of the bondsman to appear on the face of performance and payment
 1-4     bonds.
 1-5           BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
 1-6           SECTION 1.  Section 2553.021, Government Code is amended to
 1-7     add the following:
 1-8           (f)  All bonds required under this chapter shall include the
 1-9     name, street address and telephone number of the bondsman clearly
1-10     displayed on the face of the bond:
1-11           SECTION 2.  Section 2553.024(a)(2) Government Code is amended
1-12     to read as follows:
1-13                 (2)  a copy of the payment and performance bonds for
1-14     the public work, including bonds furnished by or to the prime
1-15     contractor.  The bonds shall include the name, street address and
1-16     telephone number of the bondsman clearly displayed on the face of
1-17     the bond.
1-18           SECTION 3.  Section 2553.026(b) Government Code is amended to
1-19     read as follows:
1-20           (b)  The copy of the payment bond or public work contract is
1-21     [prima facie] prima facie evidence of the content, execution, and
 2-1     delivery of the original.  The bonds shall include the name, street
 2-2     address and telephone number of the bondsman clearly displayed on
 2-3     the face of the bond.
 2-4           SECTION 4.  This Act takes effect September 1, 1999.
 2-5           SECTION 5.  The importance of this legislation and the
 2-6     crowded condition of the calendars in both houses create an
 2-7     emergency and an imperative public necessity that the
 2-8     constitutional rule requiring bills to be read on three several
 2-9     days in each house be suspended, and this rule is hereby suspended,
2-10     and that this Act take effect and be in force from and after its
2-11     passage, and it is so enacted.
