A BILL TO BE ENTITLED
1-1 AN ACT
1-2 relating to the applicability of procedures governing restrictive
1-3 covenants in certain residential subdivisions.
1-4 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1-5 SECTION 1. Section 201.001(a), Property Code, is amended to
1-6 read as follows:
1-7 (a) This chapter applies to a residential real estate
1-8 subdivision that is located in whole or in part:
1-9 (1) within a city that has a population of more than
1-10 100,000, or within the extraterritorial jurisdiction of such a
1-11 city; [or]
1-12 (2) in the unincorporated area of:
1-13 (A) a county having a population of 2,400,000 or
1-14 more; or
1-15 (B) a county having a population of 190,000 or
1-16 more that is adjacent to a county having a population of 2,400,000
1-17 or more; or
1-18 (3) in the incorporated area of a county having a
1-19 population of 190,000 or more that is adjacent to a county having a
1-20 population of 2,400,000 or more if the subdivision:
1-21 (A) is governed by one property owners'
1-22 association; and
1-23 (B) contains more than 15 separate sections in
1-24 which each section is governed by separate restrictive covenants.
2-1 SECTION 2. This Act takes effect September 1, 1999.
2-2 SECTION 3. The importance of this legislation and the
2-3 crowded condition of the calendars in both houses create an
2-4 emergency and an imperative public necessity that the
2-5 constitutional rule requiring bills to be read on three several
2-6 days in each house be suspended, and this rule is hereby suspended.
