No. 3740 1-2 (In the Senate - Received from the House May 5, 1999; 1-3 May 6, 1999, read first time and referred to Committee on Human 1-4 Services; May 12, 1999, reported favorably by the following vote: 1-5 Yeas 4, Nays 0; May 12, 1999, sent to printer.) 1-6 A BILL TO BE ENTITLED 1-7 AN ACT 1-8 relating to the location of administrative hearings conducted by 1-9 the State Office of Administrative Hearings on behalf of the 1-10 Department of Protective and Regulatory Services. 1-11 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: 1-12 SECTION 1. Section 40.066, Human Resources Code, is amended 1-13 by adding Subsection (f) to read as follows: 1-14 (f) Unless otherwise agreed by all parties to a contested 1-15 case, a hearing conducted by the State Office of Administrative 1-16 Hearings on behalf of the department under this section must be 1-17 held in the department's administrative region in which the conduct 1-18 at issue in the case occurred. 1-19 SECTION 2. This Act takes effect September 1, 1999. 1-20 SECTION 3. The importance of this legislation and the 1-21 crowded condition of the calendars in both houses create an 1-22 emergency and an imperative public necessity that the 1-23 constitutional rule requiring bills to be read on three several 1-24 days in each house be suspended, and this rule is hereby suspended. 1-25 * * * * *
